NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #51

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence was 29 July 2025. It resumed again over 1 to 2 September for closing submissions.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February 2025. Sandie Peggie returned to give more evidence on 29 July 2025.

JR - Para 8 the values of underlying equality are dignity and autonomy. What a discriminator does is deprive someone of valuable options. Defined in para 9, the ability to design the course of our lives through a succession of choices. The discriminator interferes, takes away, the ability of the person to make those choices because of the PC. Someone's life is shaped

Nobody can be seen as a specific gender. They can try to portray it, such as it is, but they can't force people to see it. Or to give it any importance.

or to define the word woman other than when it is used in the EA. It is not about toilets, workplaces, etc. It did discuss the exceptions that can be relied on to allow duty bearers (service providers) to discriminate in certain circumstances. These exceptions are concessions

All this because men who believe they have a inner 'gender identity' (that no one else can verify) want to be present when unconsenting women/girls get undressed, and won't accept the word 'no', have been enabled by the NHS.

And a Dr who says he would treat (without consent) a woman who only consents to female Dr's.

Astounding. And a bit sickening the government haven't taken action on this abuse of women.

She seems to be mostly just repeating TRA stuff, in the hopes that the judge and panel will prefer that to NC's GC stuff, I don't think she has much else to work with!

Just reading through the last and current threads and trying to get my head around the GMC's rationale for issuing a new registration number due to a change in gender.

I am on a professional register - I could change my name or gender (though I'm not sure the latter is recorded anyway) but would keep the same registration number, thus ensuring any relevant matters associated with that number are not lost.

I can't understand why this doesn't apply for doctors.
