Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence was 29 July 2025. It resumed again over 1 to 2 September for closing submissions.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February 2025. Sandie Peggie returned to give more evidence on 29 July 2025.

Docs were added not in June but in May. They were not scattered through the bundle, it was indexed. There were no documents associated with various discussions, the IT search did not throw up anything further that what had been produced.

The C has asked for a version history of the Datix, but the Datix has all the dates on it in the bundle. On the failure to produce Jamie Doyle as a witness, we produced other witnesses. On Angie Shepherd, she did not play a pivotal role in any decisions. On Michele Farrow, she had much absence

and it was more appropriate to call someone else from HR. In respect of the names of people who agreed with SP, these names were not made available until the end of the hearing. And it is not true that DU refused to cooperate, it was Cs rep that cancelled the intro meeting with DU, unilaterally.

Two matters; contrasting character of C and DU. Contr char is one of the inconvenient truth that hinders the C's case. We invite the Tribunal to conclude that C holds strong and intolerant views on people of colour, gay people and trans people. n

So JR's preferred witnesses, who don't know what sex they are, are entirely reliable witnesses, but SP was lying through her teeth? I would expect the panel to see through that.

It is possible she's dealt with it at length in written arguments.

But here, the argument appears to be that Peggie behaved abominably towards Upton and presumably deserved what she got.

One of the key moments from yesterday's session was the row over the “deadnaming” of Dr Beth Upton.
Deadnaming is the act of referring to a transgender person by their previous or birth name, rather than the name they currently use.
Naomi Cunningham, for Sandie Peggie, told the tribunal she wanted to publish her client’s written arguments in the name of “open justice”. But Jane Russell KC, for NHS Fife and Dr Upton, objected, insisting Dr Upton’s previous name must be redacted.
She described the use of the “deadname” as “harmful”, “deeply delegitimising” and said “no one should be outed, everyone should be treated with courtesy and dignity.”
Ms Cunningham argued the name was already “out there” in public reporting.
She also warned of what's known as the Streisand effect — where a bid to keep something confidential only makes it spread further.
In the end, Employment Judge Sandy Kemp sided with Ms Russell, ruling the documents must be redacted before publication.

And look how that worked out for her. #TheoUpton trending all day until bedtime on TwiX. 😁

Ms Russell says that Ms Peggie held intolerant views of gay people, minorities and trans people.
She says that Ms Peggie had "strong dislike, disgust and mockery" towards Dr Upton when she referred to Dr Upton as "it" and a "weirdo".
In evidence, the tribunal heard that Ms Peggie had made racist jokes in a private group chat, while she was also accused of homophobia and transphobia.
She says there is no trace of the "ordinary kindness" in the claimants argument.
Referring to a comment that Ms Peggie wanted to post bacon through a letter box of a mosque, she says it is incorrect for Ms Peggie to say she heard this remark made by a paramedic and simply repeated it.
There was also a report to NHS Fife that Ms Peggie had referred to a colleague as a "P*".
She says it offensive to working class people to argue that these terms are often used in these communities.
Ms Peggie's views on race and gender seeped into her work life, the barrister argues.
There also was no other witness in this case who had anything negative to say about Dr Upton - only Ms Peggie.
