Judge McCloud seeks re-hearing of the Supreme Court FWS appeal

https://www.theguardian.com/society/2025/aug/18/transgender-judge-supreme-court-case-biological-sex

'The UK’s first transgender judge has launched a case against the UK in the European court of human rights challenging the process that led to the supreme court’s ruling on biological sex.
The retired judge Victoria McCloud, who is now a litigation strategist at W-Legal, is seeking a rehearing of the case, arguing that the supreme court undermined her article 6 rights to a fair trial when it refused to hear representation from her and did not hear evidence from any other trans individuals or groups.'

The Amnesty representative was, I believe, non-binary?

Strangely enough Michael Foran is not convinced

I wonder if he is only arguing for the post - surgical group then? Is that the case?

McCloud is only about the post-surgical group? Do all the other *extreme transgender activists know this?

*extreme activists being those who demand gender is prioritised over sex when sex matters.

I think he is in quite the bind, because he obviously believes he is a special type of transwoman that has had surgery and has been 'living as a woman' for decades. And he knows that some of the public will be more sympathetic to the argument that someone who has had surgery on their male genitalia should have a special case made for them when it comes to being put in a male prison.

But he also knows that many of the people supporting his cause don't think that transwomen need to have surgery. After all, we've been told that a penis isn't a male body part 🙄 So I'd imagine VM is treading a fine line trying not to piss off these supporters, but it is inevitable it will happen eventually.

I think people like McCloud and other tw who think they now have 'female anatomy' will eventually turn on the proponents of self ID, especially when their challenges to the Supreme Court get them nowhere. I suspect there will be a big fracture in the 'community'.

That's already happened / is happening. TRAs and trans identified people are not a monolith any more than feminists are.

This is from 2012: https://freethoughtblogs.com/nataliereed/2012/04/02/harry-benjamin-syndrome-syndrome/

It's mostly a load of rubbish but if you can mentally translate the gender jargon it provides a little insight into the schism around gatekeeping, which has never actually been 'resolved' and continues to cause infighting, although the Self ID factions do now dominate.

But as with feminists, people are often prepared to put some disagreements to one side if they feel they can unite behind a shared goal.

I was hoping for some fun reading the donation comments, but I think they might be switched off? I suppose people have learned that meanies might pay a pound to make a sarcastic point.

Ah, I think I've found the reason this is back in the news.

https://www.irishlegal.com/articles/britains-first-trans-judge-crowdfunds-to-challenge-uk-in-strasbourg

Crowdfund launched. (Whatever happened to the joint effort with the GLP?)

Anyway, McCloud has managed £150 so far.

The hilarious clown trainwreck of the GLP challenge to date is summarized here. It is going very badly.
Includes mention of MCloud's latest challenge at the end. It looks like McCloud who was working with GLP broke away:

So if this dismissed, as MF suspects it will be, what will happen next? Will they go away and think of a new angle with which to challenge the ruling?

Thank you. That's a very funny read - especially the dying swan "NB" lawyer who appears to be a key performer 😂

Do you think someone should tell them to google the historical use of a double lightning flash?

MrsOvertonsWindow · 18/08/2025 12:51

Has anybody ever clarified why Stonewall failed to use any of their millions in representing the alleged "trans point of view" at the SC? Given all the wails about lack of representation (and yes, I know that the whole Scottish government case represented trans demands), it seems very odd that Stonewall ran away from all this?

I wonder if the point is just to keep raising challenges indefinitely so that they can continue to claim that the decision might change?

yetanotherusernameAgain · 18/08/2025 13:00

To be fair, I think there are 3 lightning flashes in their logo - a white one in the middle.

yetanotherusernameAgain · 18/08/2025 13:02

I wonder if the point is just to keep raising challenges indefinitely so that they can continue to claim that the decision might change?

It also maintains the sense of victimhood.

TheUnusuallyQuerulentMxLauraBrown · 18/08/2025 13:09

Crikey, former judge Mcloud is an extremely petulant man (using the EQ10 definition, ‘a biological male of any age’).

Fortunately, we are all well used to ignoring toddlers who demand cutted up pear.

They don’t have to go to “male rape crisis”, they can go to one of the many mixed sex services. Just not the female only ones.

That's the problem they want the female only one

Merrymouse · 18/08/2025 13:00

Quite possibly, but the narrative will have to move from the SC judges are the baddies to the ECtHR are the ones denying them their human rights.

And if the ECtHR dismisses the case it will dispel the myth that the SC refused to listen to trans voices, so they won't be able to keep parroting that. They will have to find a new argument with some substance behind it.

But, yes, I suspect there will be endless legal challenges

GargoylesofBeelzebub · 18/08/2025 13:10

Has he actually made public his application for intervention yet? Seems odd that he hasn't. 🤔

Yes, and that LGBTQ Consortium thingy. And the Beaumont Society… and Gendered Intelligence, GIRES amongst others.

Why didn’t S’Whittle just resurrect PFC for their Supreme Court intervention application?

ArabellaScott · 18/08/2025 13:13

'Since the Supreme Court ruling on the meaning of ‘sex’ in the Equality Act on 16 April, four organisations – the trans advocacy group TransLucent, the civil liberties group Liberty, Jolyon Maugham KC’s Good Law Project, and the Trans Legal Clinic – have launched no fewer than seven crowdfunders in support of proposed legal challenges to the ruling and/or the response of the Equality & Human Rights Commission (EHRC), or other related legal action.
To date, the seven crowdfunders have collectively grifted a total of some £663,000. And, were the five still open crowdfunders to reach their current targets, that sum would rise to almost £950,000. Which is a fuck of a lot of (other people’s) money.'

Challenging reality don't come cheap.

' The decision McCloud is complaining about dates from 7th Oct 2024 and there is a 4 month time limit to lodge an application with the ECtHR. That expired 6 months ago.'
