'The UK’s first transgender judge has launched a case against the UK in the European court of human rights challenging the process that led to the supreme court’s ruling on biological sex.
The retired judge Victoria McCloud, who is now a litigation strategist at W-Legal, is seeking a rehearing of the case, arguing that the supreme court undermined her article 6 rights to a fair trial when it refused to hear representation from her and did not hear evidence from any other trans individuals or groups.'

These days the editorial stratum at the Guardian seems mostly concerned about things closer to home like potential redundancies (their own) and fundraising from its readership to keep the paper afloat.

Unfortunately the readership already gave all its money to Jojo Batshit.

I think because if there was some way of getting the Supreme Court judgment thrown out or overturned (there isn't), they could just say, "Stupid Supreme Court judges got it wrong, now back to business as usual", whereas changing the law would require a majority of MPs to debate on and actually vote in favour of erasing women in law. And even MPs who think they are "allies" don't want to lose their jobs at the next election.

There’s also plenty of seething about it on TRA Reddit.

Do we all have a 'right to a fair trial' if we fancy putting our oars in on a case that doesn't directly involve us?

So is he arguing that it shouldn’t apply to those transwomen who have had full “bottom surgery”. That these people are a different case and so should be treated differently to “Pete the Plumber who put on a dress and now is announcing he is a woman”.

Because I am pretty sure that that is heresy as far as the average TRA is concerned.

Interestingly 5 years ago I probably would have agreed but we are well past that point now.

I've noticed that many TW who have had surgery (because they feel so strongly that women are female that they undergo drastical medical interventions to embody this belief) often like to gatekeep TW like this.

It's interesting - I doubt they would ever post on X that being trans means having surgery to look like the opposite sex, because that contradicts so much of the current self-id talk. But everything they do seems to act towards this

That's long been the case. Men who've had genital surgery think they're 'more female' than men who haven't.

It's very sad, really.

My thought exactly. How can McCloud talk about a fair trial when it wasn't a trial at all? What he's grumping about is that the Supreme Court didn't hear evidence from individuals - on either side of the argument.

It is interesting where this argument based on having "female anatomy" will go. Is the idea to have different rules for pukka TWs who have "female anatomy" and leave other TW in the cold? (This will likely divide the TWAW crowd?) Or are these TW with "female anatomy" supposed be the Trojan horses who will then bring everyone who identifies as a women with them surreptitiously? Hmmm.

What’s with the repeated claim of having ‘female anatomy’? He doesn’t have female anatomy, never has done and never will. Women aren’t low-testosterone men with breasts who lack a penis and testicles.

This is so fucking insulting to female rape victims (not you, what he said, obviously!)

Many men see it as a real achievement to have their genitals surgically altered, a rite of passage, and I would say almost as a kind of quasi mystical 'transition' into 'being a woman'.

The truth of it being a risky plastic surgery procedure that has no impact on their sex would be quite a difficult truth to accept, I imagine.

Tensions between men competing to be 'more women' have long been a feature of the 'trans community', though. And given that the vast, vast majority of males who claim a trans identity have a penis, I expect the backlash would be pretty strong.

"Anatomy" is code for surgery, but I thought the law was clear that it would be inhumane to demand surgery in exchange for legally changing gender! Hmm

I think to get anywhere with this he's going to have to demonstrate that the mens loos in the supermarket/office/pub/theatre wherever (where, as a PP said, young boys manage to go to the loo without incident) are indeed a dangerous place for TIMs to go and that a significant number of TIMs in the UK have been assaulted by non TIMs and non punters in there.

Good luck with that Victoria as I dont believe it happens. All the men I know would barely notice a man dressed as a woman in the mens loos or if they did, might internally roll their eyes and think what a prat, but they wouldn't interact with them in any way. Maybe there are some tucked away seedy toilets used for sex work on lorry parks etc but I think its pretty well documented that violence there is related to sex work and of course the very ladylike TIMs like Victoria wouldn't be frequenting those places (and its mainly women being assaulted anyway).

Another one I actually feel slightky sorry for, a career in law, hard-won no doubt, but reputation retrospectively ruined by out of control proclivities.

The other problem is that a service provider only needs to reasonably accommodate protected characteristics, hence often non existent provision for people with disabilities.

I think people like McCloud and other tw who think they now have 'female anatomy' will eventually turn on the proponents of self ID, especially when their challenges to the Supreme Court get them nowhere. I suspect there will be a big fracture in the 'community'.

Yes, these older ones that have actually had their penises removed and do actually attempt to dress like age equivalent (stereotypical) women clearly think that they are 'more trans' or better than the newer breed of young people that are more into being non binary, gemder fluid etc and wear dresses with beards and have ladycocks etc. I can't see the forced teaming lasting either.
