Only came to light because of the court case involving him claiming a woman in prison had been 'transphobic'(he lost). Presumably this man remains in the women's estate.

Christ, that's immensely worrying.
The thing I find really infuriating is that if you bring this up with anyone in real life, you sound like a nutcase. Because of course wiping criminal records on, essentially, the say so of that prisoner is absolutely crazy. And the guardian won't cover it so you end up sounding like a conspiracy theorist who only gets their information from dubious sources. I'm finding the whole thing quite difficult to deal with.

This is precisely what we've always been concerned about. Remember the DBS has special exemptions for members of this "sacred caste" where they're exempted from the some of the standard procedures that every other adult wanting to work with children has to undergo.
It's time for all these organisations to grow up, recognise the threats that some adults offer to society and stop giving these men (and some women) special exemptions.

When will it all stop and for it all to just close down to either fulling tracking any changes made in a very clear way. ie. No new records being created just because someone has changed name and artificially changed their sex marker.

This is absolutely shocking, when you have a DBS check, they ask if you are / have been known by any other names. We spoke to a mortgage advisor last week and had the same. Surely the cops can port his record to his new name.

And I hope to goodness he's not in a women's jail now.

There is a lot of confusion over trans name changes and the impact on a dbs check.

There is indeed a special Gov dep which handles trans people's dbs checks but this is simply so the employer doesn't see the old names, which the applicant does need to divulge.

Basically anyone using this route IS divulging their previous names, but in the knowledge that this will be confidential.

The problem is where the applicant doesn't reveal the old name. And why would they if they think they won't be caught? And especially if they have something to hide?

This is the big issue with anyone changing their name. If they don't disclose it, the dbs may not pick it up. For most people there will be other ways to connect the dots - for example the birth certificate will be the same. But a gender recognition certificate allows for a new birth certificate in the new name. The National Insurance number will be updated to show the new name and gender. It's going to be very difficult to tie the old and new identity - which is of course the point.

I’ve never understood why legislation or policy is written that relies on criminals being truthful and civic-minded.

Why would legislators think that criminals will willingly and actively inform the police & probation services of any change of address or name, or that they will be honest on DBS checks, or that they will refrain from using computers or phones or weapons if told not to? Refusal to obey all these reasonable strictures needs to have criminal penalties and be enforced by the police/probation services etc.

Anti-social members of society love loopholes. And laws written without considering the negative outcomes (e.g. the GRA) give loopholes that WILL be used by bad people.

This man is the one who is in an apparently sexual relationship with one of the women he is incarcerated with, Nyomi Fee a child killer. Because he complained of being bullied and misgendered by another female prisoner, which resulted in her being prosecuted, we know the only 'gender affirming care' he has had is having his Adam’s apple shaved. The Scottish taxpayers would have paid for whatever he surgery wanted. He isn't woman enough to want his dick removed.

I think Fee was 29 in 2016, if there relationship is sexual I wonder how they avoided pregnancy? Was the Prison Service providing contaceptives? Fee was in a Civil partnership with the mother of the child they murdered but they're serving their sentences in different prisons because....relationship?

The woman they accused of bullying was found not guilty and, I believe, is sueing. She claims, amongst other things, her release has been delayed because of accusations of transphobia.

Agree. It is chilling.

Sadly it was entirely predictable. And yet nobody is listening. The absolute BS waffle that is in the job spec/adverts for the senior appointments under Appointed for Scotland, for instance. The skills they talk about needing… When in reality, what they really need is just someone with a backbone to give the most basic of reality checks. It gives me the rage.

Yes. The DBS offers a very special confidential phone line where members of the sacred caste may - or may not - disclose their previous identities.
They argue that this isn't a loophole - completely ignoring the fact that predators have a vested interest in lying about a criminal history of abuse in order to access children.

"Dr Kate Coleman, of Keep Prisons Single Sex, said there should be an urgent inquiry into the fiasco.

She said: “When I found out that Alan Baker/Alex Stewart had been able to conceal his record of offending in this way, I was shocked but unsurprised.

“Our research demonstrated that individuals who ‘change gender’ as part of changing their identity are awarded uniquely enhanced individual privacy rights which enable exactly this sort of thing.

“This won’t be an isolated case – this is standard practice north and south of the Border.

“It has widespread ramifications including for safeguarding and the operation of Disclosure Scotland checks. For years we have been calling for urgent changes – not just for the recording of data, but the handling and disclosure of data.

“We cannot have a two-tier system where certain individuals are ‘entitled’ to conceal vital information on frankly concocted grounds.

“There must be an urgent investigation into how this has been allowed to happen. I would be delighted to work with the relevant authorities to share our findings and ensure that the necessary steps are taken to ensure that this cannot be permitted to happen again.”

It's one of the worst cases in Scottish criminal history. It happened in the next village.

She and her wife tried to pin the blame for the murder on one of their other children.
