Now counsel for UCU is effectively saying that if Wayne and O'Neill have argued in favour of the protected characteristic of sex in an email, they should also have argued in favour of the protected characteristic of gender reassignment.

What I find interesting is how the witness today and yesterday are able to formulate an argument much better than other academic witnesses we have heard from e.g. those in the OU case

Effectively the judge said that she didn't expect the panel to be ruling on what dogwhistle means and so long discussions about the nature of the term were not helpful, especially in view of time constraints.
