NHS Fife tries to silence nurse

So as has been mentioned on threads about the Darlington nurses a nurse is sueing NHS Fife over its trans staff policy.
The poor nurse was forced to get changed infront of a man in the female changing facilities, when she complained about it she was 1st told to change in a cupboard if she didn't like it, then they tried to bully her into swapping shifts so she didn't work with the man in question (she wouldn't), then they wanted her to move hospital (again she refused) so then they suspended her without pay for months until her solicitor got involved and now they are trying to gag her by insisting that the court case (starts in February) must be held in secret (I wonder why) and will be in crt next month asking to restrict reporting on the case.

This case is really important in Scotland because the trans staff policy that's going on trial in this case is the Scottish government's own policy used in all public sector organisations in Scotland and works on self id. So when this case is won it will finally kill the Scottish government's self id policy in all public bodies

That doesn't stop it being sexual harassment.

Boiledbeetle · 04/02/2025 10:32

Trying to say SP was blocking Beth's exit from the changing room. SP says she wasn't and Beth could have walked past her.

I already want to throw things - is Russel just throwing random things hoping they will stick?

Ereshkigalangcleg · 04/02/2025 10:32

Also indirectly sexual harassment and sexual assault is more of an issue for women and girls than male people.

Reporting Scotland made an incomprehensible hash of this story last night. Anyone uninformed on this debate would have thought two women in a changing room didn't like each other. Even my DP had to have me explain it to him that the doctor in question was a man. It isn't obvious in the reporting.

The BBC headline was along the lines of ‘Nurse won’t share room with transgender colleague’.

So deceptive and unreasonable.

The onus is on Sandie Peggie to prove her case that she was discriminated against/harassed, so she just needs to undermine that.

ItsAllGoingToBeFine · 04/02/2025 10:34

OMG, presumably Upton was moving at the time ....

There seem to be two Dr Uptons. (Apart from the two on the different GMC records, that is.)

One who is harmless, vulnerable and stressed at unkindnesses.

And another who makes contemporaneous notes on his colleague, insists she make eye contact, puts in a complaint that gets her suspended, and casts doubts on her professionalism. This second Dr Upton seems to be gunning for a female nurse.

Wonder which version of Dr Upton she met in the women's changing room.

Per the info from Sex Matters:

According to the General Medical Council (GMC), Upton graduated from the University of Dundee with a medical degree in 2021, and qualified in August 2022. The tribunal reports that Upton began publicly identifying as a woman in 2022 and started work at the Fife hospital in the A&E department in August 2023.”

So the Dr Upton who qualified (but apparently no longer exists and is not registered and cannot practice) started work a year after that qualification - let's pass over the fact that the person now actually working didn’t qualify under that name but hey ho - and so was a very new doctor indeed when the contemporaneous note-taking started. It would appear to have started very soon?

Sandy Peggie is a highly-experienced nurse with a 30 year career behind her.

I know who I’m supporting here and it isn’t the one who thinks we should 'be kind'. Can’t log into the tribunal unfortunately but thanks for all the comment here, which is invaluable.

Yes, she is throwing shade

Boiledbeetle · 04/02/2025 10:35

JR trying to say SP is changing her story about where SP and Dr Upton were in the changing room relative to who was closer to the door.

themostspecialelfintheworkshop · 04/02/2025 10:36

It seems to me the way JR is talking to SP is incredibly patronising and disrespectful. It's not a neutral tone.

Boiledbeetle · 04/02/2025 10:36

Did JR just refer to Dr Upton as he?

nauticant · 04/02/2025 10:36

I think one thing that doesn't do Russell any favours is that she has a very gotcha style of cross-examination. It relies on clever use of words and looking for the kind of discrepancies that are perfectly reasonable, and to be expected, in normal human interactions.

Signalbox · 04/02/2025 10:36

Why is this so important?

ItsAllGoingToBeFine · 04/02/2025 10:36

Is Russel trying to rile the witness? (And threaten)

chilling19 · 04/02/2025 10:36

Let me warn you? Condescending madam

Boiledbeetle · 04/02/2025 10:37

JR now threatening SP for being evasive

Cailleach1 · 04/02/2025 10:38

Boiledbeetle · 04/02/2025 10:36

Did JR just refer to Dr Upton as he?

Haha. Even JR can’t keep up the pretence.

Signalbox · 04/02/2025 10:39

Strikes me it's quite tricky to know exactly at what point a conversation started in a situation like this. It's not exactly an exact science is it? She's clutching at straws a bit if she thinks this is what will undermine SP's case.

chilling19 · 04/02/2025 10:39

Peggie doing a good job in remaining calm

themostspecialelfintheworkshop · 04/02/2025 10:40

Ereshkigalangcleg · 04/02/2025 10:30

I personally would support any man who complained about being made to change with women. Men deserve privacy and dignity too.

Yes, and although they wouldn't be at physical threat, many men would be uncomfortable and feel harassed or have religions which prohibit women in men's spaces such as this.

ItsAllGoingToBeFine · 04/02/2025 10:40

WRT Russel's tone there has been some interesting chat about how this case is also about class. Russel is obviously speaking down to someone she perceives as being lesser.

themostspecialelfintheworkshop · 04/02/2025 10:41

Are the prosecution allowed to threaten 'I'm warning you' the witness like this?

Harassedevictee · 04/02/2025 10:41

JR is trying to show SP was blocking the exit and being aggressive to poor vulnerable DU.

HousesofHolbein · 04/02/2025 10:41

Ereshkigalangcleg · 04/02/2025 10:32

Yes, I think there has to be recognition that a reverse situation with a trans id woman in male CR. The risk is still to the woman in the situation.

I'm very supportive of both sexes having access to SSS but the risk posed by women to men is to privacy and dignity without the added physical power imbalance
