NHS Fife tries to silence nurse

1000 replies

Hoardasurass · 13/10/2024 09:36

So as has been mentioned on threads about the Darlington nurses a nurse is sueing NHS Fife over its trans staff policy.
The poor nurse was forced to get changed infront of a man in the female changing facilities, when she complained about it she was 1st told to change in a cupboard if she didn't like it, then they tried to bully her into swapping shifts so she didn't work with the man in question (she wouldn't), then they wanted her to move hospital (again she refused) so then they suspended her without pay for months until her solicitor got involved and now they are trying to gag her by insisting that the court case (starts in February) must be held in secret (I wonder why) and will be in crt next month asking to restrict reporting on the case.

This case is really important in Scotland because the trans staff policy that's going on trial in this case is the Scottish government's own policy used in all public sector organisations in Scotland and works on self id. So when this case is won it will finally kill the Scottish government's self id policy in all public bodies

Strikes me it's quite tricky to know exactly at what point a conversation started in a situation like this. It's not exactly an exact science is it? She's clutching at straws a bit if she thinks this is what will undermine SP's case.

If this is the best she's got basically trying to insinuate "ah ha you said you were fractionally to the left of where you are now saying you were, therefore you're lying"

JR is trying to show SP was blocking the exit and being aggressive to poor vulnerable DU.

I'm not sure such blatant aggressive questioning and direct threats is the way to go. Especially since SP is very calm and not aggressive at all.

ItsAllGoingToBeFine · 04/02/2025 10:42

Is Upton getting questioned at any point?

Ereshkigalangcleg · 04/02/2025 10:42

I'm very supportive of both sexes having access to SSS but the risk posed by women to men is to privacy and dignity without the added physical power imbalance

I agree.

Are the prosecution allowed to threaten 'I'm warning you' the witness like this?

I assume NC would interject if not. I've heard Ben Cooper doing similar when a patient refused to answer a question straightforwardly.

Madcats · 04/02/2025 10:42

Presumably a hulking great mid-20's bloke is perfectly capable of asking a slim-looking middle aged nurse to let them pass (even if they were in the way, which I very much doubt).

AnnaMagnani · 04/02/2025 10:42

Thanks @Szygy

So Sandy Peggie is a highly experienced nurse who would be invaluable to any department.

Versus a doctor who was what, an FY2/possibly CT1 who would only be in the department a few months?

The act of going into the female changing room really emphasizes how unfemale Dr Upton is. Female junior doctors universally report how they experience sexism than male doctors don't, and one of these things is that they must never upset the nurses for any reason while male doctors generally get away with allsorts.

Dr Upton has just assumed he can do as he likes, despite being very junior and essentially unimportant, with the male confidence that he knows he will be backed up.

Agreed but as we have seen in other cases they have to use everything they can.

Is Upton getting questioned at any point?

I assume so since he is one of the respondents. I imagine things would go badly for him if he doesn't give evidence.

ickky · 04/02/2025 10:44

It wasn't beth's decision to be in the cr.. really!

nauticant · 04/02/2025 10:44

Russell saying that Upton had no choice but to be in the changing area and had been forced to do so by management.

themostspecialelfintheworkshop · 04/02/2025 10:44

So Beth doesn't have free will then? Beth could make sure he's not in the WOMEN'S changing room when he'd upset women couldn't he? But maybe it wasn't the changing room that was what he wanted?

Boiledbeetle · 04/02/2025 10:44

"What purpose was there raising it directly with Beth?"

FFS what other choices did she have, her manager had done fuck all and basically hoped the whole thing would go away.

Oooh. I hope they throw the NHS under the bus. Poor Dr Upton being FORCED into the women's changing room (when all those other women were there and not waiting outside until they'd left, like the women did).

Signalbox · 04/02/2025 10:46

What do they think a woman should do when they find a man in the woman's changing room. This line of questioning is bizarre.

Well shut up and not have free speech and never raise any concerns. It's a bit Taliban-y.

WRT Russel's tone there has been some interesting chat about how this case is also about class. Russel is obviously speaking down to someone she perceives as being lesser.

My experience of the NHS is that this is almostly certainly a class issue.

I mean Beth could have said " no it's OK I'll change in the men's as I wouldn't want to make all the female staff uncomfortable "

Poor Beth with no agency of Beths own!

themostspecialelfintheworkshop · 04/02/2025 10:48

Do they really want nurses to be scared to speak to men? What if they notice clinical errors? Are they supposed to stay silent then too?

themostspecialelfintheworkshop · 04/02/2025 10:48

I need to do some work but I'm so fucking furious I can't concentrate.

Boiledbeetle · 04/02/2025 10:49

JR "no objective reason to feel intimated by Beth's presence"

Grrrrrrrrrrrr

TWETMIRF · 04/02/2025 10:49

JR has a very annoying voice

This is exactly what trans staff I've worked with did. But this was back before activists and policy writers got involved so everyone just used their commonsense and empathy.

God knows what would happen now.

nauticant · 04/02/2025 10:51

JR: why did you not go nuclear in making your complaint?

later

JR: why were you so assertive in the changing room?

Peggie can't win in this kind of thinking.

Mmmnotsure · 04/02/2025 10:51

According to the lawyer, the hospital investigation don't think it likely that Dr U would have started to undress because 'she' was so distressed, attacked etc. They believed him.

That's okay, then. Must be true.

Obviously, no man who insists on going into a female changing room where women are undressing and he knows at least one women doesn't like it, taking his clothes off, insisting on eye contact - no one like that would start undressing in front of that woman, or do anything intimidating.
