Employment Tribunal Case to Protect Single-Sex Facilities at Work

Dear Mumsnet Members,

I have issued an employment tribunal complaint against NHS England to protect single-sex facilities at work.

A preliminary hearing will be held in early October 2024. I would be very grateful for some urgent gardening support at CrowdJustice. I won't add a link here as it is against Mumsnet rules.

It would be interesting to hear other people's views on legislation around single-sex facilities at WORK. However, I won't be commenting much on this public forum whilst the case is on-going.

Thanks all, I'm alright, it just shows how none of these processes have been designed with victims in mind, I'm not even a claimant in a criminal trial against a perpetrator, sometimes I really feel for those women.

We're going to try anonymity again now instead of leaving it till Feb.

Crowdfunding still needed on this side of Christmas, as we've got work to do. Disability impact statement is next. I'd be grateful if people could keep sharing the link.

Happy new year, all!

I haven't heard back from the ET regarding the application for anonymity. Since they might decide on that at the second preliminary hearing which is scheduled for February, I need to start preparing for that hearing.

I have now responded to quite a lot of very detailed additional questions from the Respondent on how my PTSD impacts on my day to day activities. They already had five pages. Now they have another five. I'm hoping they agree to disability status.

Recent cases like the nurse in Fife have confirmed how difficult it is to get anonymity in these cases. I imagine your lawyers are well aware of all the kill terfs placards and the like and will be able to make a far better case than the Fife lawyers. I've donated in the past to help make that case and I'll be considering it again at the end of January.

The Defra/SEEN claimant was denied anonymity too in November.

Thank you for donating. I was hoping news on the anonymity before Christmas but I think I need to assume they might just decide on it on the scheduled day in Feb, which means I then need to cover costs for a second preliminary.

My barrister, Naomi C, is the same as in the Fife nurse case.

I have some specific reasons why I've applied for anonymity and it's certainly different to a man wanting anonymity because he's worried of being 'outed' as a male.

Sorry i meant that the trans person who was named as Second Respondent in Fife case did not receive anonymity. Not sure what's going on with the Defra case.

How would anonymity work when you have already publicised your case on CrowdJustice and Mumsnet? A court won’t order anonymity when the person asking for it is the one seeking publicity.

If that has been done under a pseudonym, then the OP has kept their anonymity.

The name here is a very made-up pseudonym. I didn't want some poor soul with a more common name who might work for the respondent start receiving queries about the case, had I happened to pick their name, so I formed a longer combo of names to differentiate from anyone else.

Defra case trans person did not get anonymity.

I agree that this is a different situation as trans people are not generally threatened at work and people dont try to get them sacked unless they are doing things anyone else would be sacked for. Still the bar for anonymity is high. You have a great barrister, I'm sure the case will be well made and I hope it succeeds.

@ElleWoods15 We have had someone turn up on mumsnet before claiming to be the person requesting help - and they lied to try and discredit the person needing help. I have no reason to believe Faye is lying but a made up name can conceal anything.

The most likely reason I can think of for a woman wanting anonymity in this sort of case is that there may be serious repercussions for her and / or her children if not granted. Given the example of intimidation, threats and behaviour that has affected many brave women's rights advocates children so far, (e.g. Kate Scottow, Posie's, JKRs and Caroline Farrow's children just off the top of my head), we need to bear in mind what a heavy burden we are placing on women who stand up if they must always be publicly named.

I do agree in general court cases should be open, but there may well be circumstances where this would cause real danger.

Personally I am increasingly convinced that society positively welcomes men who use the implied threat of harm to children to control women. Including the courts.

Have others clocked how these kinds of staff policies apply to 16-17-year-old apprentices, too? It means that a minor might find themselves showering in the same space with a recently 'socially transitioned' adult male and there is nothing the minor can do about it. Madness.
