It bears repeating anyway! The passport office is practicing self ID for "crossdressers" and they've kept quite quiet about that. Here's a recent Reddit thread:

I'm not entirely on top of gender law, but didn't FWS 3 have Lady Haldane judge that a bloke in a dress and no GRC is.......a bloke?

Then yesterday, didn't Uk judges decide that a GRC is binary (so absolutely no scope for one to be given to a non-binary individual)?

Worknest is a hefty organisation (75 employment lawyers). It seems inconceivable that they didn't think "this is going to be a tricky one..." when first approached (unless they were so poorly briefed that they gave advice blindfolded).

Aside from being able to recuse themselves, do ET panels have any choice about what cases/panels they are on?

Well, yes, but the process is designed to satisfy the fantasy of men who think people can't tell they're men.

Or, maybe, there is a thought that it is more socially acceptable to be a "man wearing a dress" if you have an F in your passport? "Oh, it's okay, he's not one of them, 'she's' one of them". Dating back to an era when transsexualism or transvestitism were less objectionable than homosexuality.

Every time there's one of these Employment Tribunals I think, well, it sounds interesting but I really don't have the time to watch the stream, then I start reading the tweets and posts, then I think I ABSOLUTELY MUST GET ON THE STREAM, and when I do I am hooked.

I had to ignore the last couple that there were threads on completely as I was busy with real world stuff and knew if I even looked I'd get completely sucked in! I tried with just the tweets and thread on this one, but it wasn't enough!!! I doubt I'm going to achieve much until it's finished!

Because you don't need a GRC to change your gender markers on a passport of driving license. You need "a letter from your doctor or medical consultant confirming your change of gender is likely to be permanent"

MW's wiki page back to 'she'. Though in searching it seems MW uses the male version of their name - the female version has an 'a' at the end. Is that right? MW keeps saying they're a woman but has kept their male name?

To enable GRC applicants to evidence that they have appropriated the sex-role stereotyped appearance and behaviour of the opposite sex 'lived in their chosen sex/gender' (a requirement for the granting of a GRC) there had to be a function for applicants to amend their sex marker on official documents such as passports and driving licences. Ergo, de facto self ID.

MR: AB had asked that organisation have a policy on how to respond.

NC: note re appeal hearing. RA pointed out her line manager had told her what not to do in circs under review, but not what to do. You agreed with this.

Just catching up.

I feel very slightly sorry for MR an unpaid volunteer landed with charing a disciplinary panel about sex & gender for an organisation whose CEO is full on TWAW. New to the role and obviously relying on MW for guidance.

MR clearly has swallowed the TWAW mantra and hasn’t thought beyond it. How many witnesses at ETs have there already been having to work through the argument on the stand and who end up looking like idiots? You would think their legal advisers would give them a heads up.

I suspect MR took advice from MW which is why gross misconduct was in the initial letter. Then advice from workday meant it was correctly downgraded to misconduct. MR is clearly protecting MW.

“MR: we shouldn't be able to divulge staff gender or medical history
NC: you're telling the SU what the person identifies as now, not what they were born as.
MR: An SU could ask follow-up Qs and the staff member could then divulge themselves”

I assume this was the policy in the data protection or privacy policy that DH was asking RA about yesterday.
