Sex Matters update

The petition worked. The full letter from the EHRC is worth reading.

EHRC link

”On balance, we believe that redefining ‘sex’ in EqA to mean biological sex would create rationalisations, simplifications, clarity and/or reductions in risk for maternity services, providers and users of other services, gay and lesbian associations, sports organisers and employers. It therefore merits further consideration.”

🍿, anyone?

TrombonesAreNotBones · 04/04/2023 15:17

oh gosh, thank you for the update and link.

Tinysoxx · 04/04/2023 15:28

Good news except I hope the word ‘sex’ isn’t going to have to become ‘biological sex’ every time.

To be honest it would be good if gender (old fashioned meaning of male or female) had both stayed the same.

Theres all sorts of problems with sex meaning both intercourse or gender.
I would prefer gender to mean male/female and man/woman and ‘identifying gender’ to mean what you feel like.

ChazsBrilliantAttitude · 04/04/2023 15:32

Sex is the correct term. Gender has a different meaning.

All they need to do is add a few words in the definitions section to say something like “sex means biological sex”

If implemented, it should also help sort the utter bin fire that RSE has become. I also like that the letter specifies lesbian and gay freedom of association, which presumably will assist the LGB Alliance and the legal case brought to test whether or not they can be a charity Confused

nilsmousehammer · 04/04/2023 15:43

Thank you for the guidance to the full letter, very interesting reading and lots of positive things considered. In essence it seems to suggest that fixing it to biological sex then protects the female sex, and it would then be possible to identify the specific areas in which additional specific protections may be needed for TW to avoid discrimination.

Tillytrotter67 · 04/04/2023 15:56

This feels VERY positive!

334bu · 04/04/2023 16:00

Hopeful dign.

Gosh this is amazing. And I'm 100% sure govt will look to legislate because it will completely fuck Labour and their bizarre fence sitting.

Bring it on.

Florissante · 04/04/2023 16:14

That's a good first step.

AHyenaofMN · 04/04/2023 16:14

This is fucking amazing.

I think.

I am more hopeful than I have been yet.

334bu · 04/04/2023 16:15

As I pointed out to my MP, who assured me that the SNP was committed to single sex services, clarifying the meaning of sex could only be helpful in ensuring these services.

Queenofscones · 04/04/2023 16:20

This is such good news. The big questions is why the legislation was so poorly written in the first place. So many women-hours and such energy required to secure the basic fact that sex is always biological.

Yes. It's intensely depressing, but there we go. If they sort this out, we can get back to all the other issues that remain as pressing as ever.

DOBARDAN · 04/04/2023 16:29

So glad the petition worked, hopefully the 'reviewing' will mean definite action is taken, so that 'sex' means biological sex

Floisme · 04/04/2023 16:32

Wow, thank you for this info op, and thank you to Sex Matters for the petition which I assume has instigated this. It looks like a huge piece of news.
(There isn't a hidden catch is there?)

ArabellaScott · 04/04/2023 16:34

Don't know, Floisme. I hope not.

There is a helpful comment or two in there talking about how times have changed and as things like the GRR increase the number of those with GRCs, the group 'women' becomes ever more porous, as well as the impact in fact meaning that freedom of association/ freedom to be part of a homosexual group/ hospital wards etc is prevented by GRCs. And that you can't ask for GRCs, which has its own impact.

It seems eminently sensible.

This is amazing, especially being in Scotland! Never thought I’d have to say it but thank god for the Tory party!

howdoesatoastermaketoast · 04/04/2023 17:09

In 2010 it was preposterous that anybody would ever be all "but what on earth do they mean by sex it's such a confusing concept?" The 2016 GRA was with hindsight not as thought through or well written as it should have been. Implications and impacts on women and women's rights were not considered at all.

Labour started this with the GRA and a badly worded EA, the GRCs should go.

Keir and his 0.1% of penis havers can sit on the fence together chanting TWAW when they rest of us get on with our lives now.

I was told Harriet Harman who previously supported PIE was involved.
