According to this KC.

'[Edward Targowski KC] spoke about Bryson's gender, saying: 'She is transitioning from male to female gender.

'If you accept that evidence, that she is transitioning, that she is aiming to continue on that path to becoming female gender, that goes a long way to acquitting her of these charges.'

It had to happen eventually.

That's simply idiotic. The accused person's 'gender' is irrelevant to the fact of whether rapes were committed or not.

So the reasons that men are not punished for raping women will grow, not just:

• she was drunk
• she was wearing a short skirt/low cut top
• she was coming on to me, when she changed her mind I thought it was a flirting tactic

Now they want to add

• I was confused about my identity and thought raping a woman might help. I was vulnerable dammit!
• I'm turning myself into a woman, women can't rape, so logically I can't have raped her because I'm a woman.

Just going to go and beat my head against a brick wall.

From the picture she is still packing the weapon it would appear, capable of carrying out a rape.

So unless they can prove she had it removed and stuck back on recently, she was still capable of carrying out a rape.

I think the KC is arguing that he was in a vulnerable state of mind, as evidenced by the transition. Not that trans = special rules or incapable of rape.

Regardless it's a fairly weak argument to my mind.

This is utterly enraging. I can only hope the jury see through this.

It doesn't matter if you are transitioning or you 'think you are a woman' at the time - you will still be guilty of the offence

But “state of mind” (in the way this KC is inferring) is not a valid defence for raping someone.

And this alleged rapist’s ‘dysphoria’ (at play since the age of 4, he’s said to have stated in court) is clearly not so strong that he feels any need to hide his penis and scrotum from public (or his own) view ^^

You’d think a skirt or looser trousers / jeans would help his self perception.

I felt speechless when I read the OP. But comments here have reminded me how essential it is to use every chance of spreading the truth. It's out there, but the lazy BeeeeKiiiind narrative remains widespread -- backed of course by the misogyny that's always been around.

It is far from the first time 'transition' has been referenced as a reason for acquittal or a lighter sentence in court.

By the looks of that photo she isn't looking to hide the fact it could well happen again as the weapon is still there in the leggings.

I believe only a very small percentage of males who identify as women give up their penis. Certainly under 10%, and that's according to Stonewall iirc. I mean, why would they?

Good for the Daily Mail using that photo. I wouldn't expect to see it in the Guardian, which must be proud of its new reputation as a bastion of misogyny.

In seriousness, I think rape and sexual assault trials should have female judges and juries.

The Daily Mail is a lot better than it used to be.

It used to have to outrageously spin and distort stories to outrage people, which is what it likes to do. People ended up misinformed due to its sensationalism. Now it can simply report what is happening, so it is getting to do what it likes AND inform people.

The Guardian on the other hand is a lot worse than it used to be.

It's increasingly clear that it thinks outraging the wrong sort of people about the wrong sort of things must be avoided at all costs, which means it increasingly will avoid reporting things that are true but outrageous. So people reading the Guardian end up misinformed.

the fact that the person’s gender has become the acquired gender does not prevent the offence being committed or attempted.
