Biden just passed all the worst parts of the Equality Act by executive order (so without going through any legislation at all). It is limited in effect to agencies (I think) but those agencies include the Bureau of Prisons, Dept of Housing and Urban Development, Dept of Education, Dept of Labor etc

This will of course be unchallenged, even welcomed by the media. It will likely have a knock on effect around the world.

And I am so angry. So so angry. He was never the ‘least worst option’ he is the absolute worst option.

horizon I am very open about my views and I have yet to be called a right wing bigot! Many people agree with me. Most of my friends feel the same way, and those that didn't now understand the issues. The prison rapes appalled both sides of the argument.
You should not be ashamed of what you believe to be right or silenced in some way by the judgement of others. You are in the closet so to speak. If we started more conversations about this surely that is a good thing, as a minimum give your friends something to think about.

Biden's move to eradicate sex based protections will be a disaster for women's rights, it must be protested and women and girls must be protected. A pact with the devil was not a better option. It's a no win situation.

I think so. Were a white supremacist president to try to introduce an EO reintroducing segregation, I think it would be struck down

The legal process was one we saw the beginnings of with Trump's Muslim ban - it never made it as far as SCOTUS, IIRC, but several lower courts ruled it illegal.

They are no longer women's rights Quaagers. They are universal rights belonging to both men and women. They are not the legal domain of the biological sex class that require the rights. The law does not now recognise the existence of a biological sex class that requires those rights.

The ability to recognise the people who OWN those rights and can exercise those rights has been abolished.
They are now universal human rights and apply to all humans: those who are male and those who are female.

I did not say the right to an abortion has been abolished. I said that women's rights are now an illusion.

Abortion is not a woman's right, if the law believes it is also a man's right. Who are the right holders under the law? Both men and women. All humans. Who can legally claim an interest in that right? All humans. How to legally distinguish between those that need and can exercise the right, and those who do not, and cannot?

You can't.
How to ensure that those people who do not need and cannot exercise those rights are excluded from influencing the future of those rights?
You can't.
There is no recognition of the existence of the class that are the right-holders and the class that is not.

It's some pretty impressive whataboutery that we now have to solve all the problems: covid, poverty, racism before we're 'allowed' to express concern about women's rights being eroded. Has anyone told Greta she can go back to school and quit campaigning for the environment because there are still people starving on some parts of the world, or that all the wars haven't been peaceably resolved?

Then there's the feeble but predictable argument from some that not 'all' rights are affected so we should just be happy with that. Like a paltry 2 week maternity leave is something worth celebrating.

Sorry, but every single girl who is denied a place on a podium, a university scholarship, protection from male bodies counts. It's not fair that we're only allowed to be outraged when the magic number of n+1 of women being screwed over is reached.

I am v concerned about this, but on reading the be executive order, it seems very woolly/high level and I'm not seeing anything that's of specific concern re prisons, sports etc. Can anyone please point me to anything specific in it (or anything that it enacts) which specifically has this effect?

I'm concerned of the direction things are moving, and where it might lead, but on initial reading, this just seems a lot of waffle, as well as since sensible stuff like access to housing, and I'm wondering whether it actually does as far as we are worried about?

Sadly, they're going to learn the hard way. America will show us exactly why this is a bad, bad idea. So many women and girls are going to be harmed because of this bullshit. But as long as the men are alright, right? That's the main fucking thing.

There's no thought gone in to this at all. No rights of other people considered. Just giving in to ridiculous demands, and putting way too much faith in predators, as if saying 'I'm a woman' or walking into a gender neutral loo/changing room will be too much effort for them to go to Hmm

This is a massive win for men's rights. Meanwhile women are going to have to start again, from scratch.

This is NOT about trans rights - it’s about women’s rights. This is blatant, state enforced sexism. Why is institutionalised sexism and misogyny to be relegated as less important compared to other forms of discrimination? This negatively impacts on all women in the US - and I would very much imagine that Muslim, Black and Hispanic women are going to be disproportionally impacted by this.

It won’t be the women in Biden’s family who lose out on scholarships/jobs or will share prison cells rapists.

Some clarification about challenging Executive Orders:

Congress may try to overturn an executive order by passing a bill that blocks it. But the president can veto that bill. Congress would then need to override that veto to pass the bill. Also, the Supreme Court can declare an executive order unconstitutional.

Obviously Congress will be a no-go for the foreseeable future so it looks like any challenge would have to go up to the Supreme Court.

Biden himself has said on camera that his intention is for any prisoner who identifies as female to be held in the female estate. By grouping gender identity with sex the order effectively makes them the same and therefore confirms TWAW when it comes to anti-discrimination policy. Therefore women will not be able to argue that a male person shouldn't compete in female events in the states or that they shouldn't be on all women shortlists, because they ARE women.
