No maintenance as yet. He pays me 700 pounds a month anyway-as he did before he left. However he is trying to cash in another 20 grand on the mortgage and my solicitor has faxed his saying fair enough as long as 10 of it comes straight to me. When he cashed in the last of our portfolio a couple of months ago (14 grand) I have just realised I saw 3 of it!

A word of caution here regarding costs. Hopefully Spook will get an order than d-t-p pays the costs of the action. However, the costs that the court allows are generally considerably lower than the bill your solicitor will present. This is because the court puts a ceiling on the hourly rate a solicitor can claim, but there is no ceiling on the hourly rate that your solicitor charges you. So there may be a shortfall, i.e. the difference between what your solicitor charges and the amount d-t-p is ordered to pay by the court. Hope this is clear.

Oh and I may have misled you earlier regarding legal aid and the equity in your property. It used to be the case that any property which was the subject of the action (or one of the subjects) was excluded for the purposes of legal aid. However, it used to be the case that any equity in property didn't bar you from receiving legal aid. So I'm not entirely certain what the current situation is and it may be that, although you have a share in the equity in your property which exceeds £100,000, as the property is part of your dispute, it won't be counted. Is that clear? As mud???

ADD £700 to you, £1,000 School Fees

Total out = £4357 plus your overdraft and credit cards

I earn £5,000 pcm so you do the math.

To which I replied....

Thankyou. I am sure no-one will be taking into account your lifestyle and your overdraft and your credit cards. I don't do the "math". The court is doing that.

Er, Spook, what happens if his business really is doing badly (i.e Sirens bombing, tee hee) And doesn't pick up really quickly? Presumably any expenditure from then on would have to soak up the proceeds from your various property sales? I'm just concerned that the longer term angle is covered and safe.

yeah, but any tactics on his part aside, what if in 2 years time, he just isn't earning the cash to pay enough to cover Spook's costs in London, school fees etc...do you know you can make enough in your new venture, Spook?

I realise that this could be a problem whatever happens, but I would be wary of setting up a lifestyle which can't be maintained without using up all the capital from property.

Sorry, I'm not being helpful at all - I'll think how to put what I mean more clearly....But it isn't just a case of introducing him to his nearest branch of Sketchleys, is it? It's about realistic and sustainable long-term planning.
