The intended meaning in the Equality Act 2010 was that the protected characteristic “Sex” means a woman, a female of any age; or a man, a male of any age.
Female and male mean being of the physical types that have larger and smaller gametes respectively, making procreation possible. Adam and Eve are symbolical of this fundamental biological binary underpinning life.
Now though, it can mean “legal” sex from a Gender Recognition Certificate which isn’t sex at all but gender, a perceived role and an appearance based on superficial aspects of femininity or masculinity, and diagnosis of dysphoria with a person’s natal sex, and living as the gender over two years.
Or, it can also effectively mean the protected characteristic Gender Reassignment, which is not sex either, but the ‘intention’ to live with the gender - role and possibly some sort of appearance - of the sex you were not born with but the definition is vague.
Surgery is not necessary for either for a GRC or Gender Reassignment under the EA.
The various Acts and aspects of them can conflict. Lawyers themselves argue over them. Stonewall and other lobby groups have been pushing for different interpretations of sex for a long time.
It has become difficult to uphold the permitted sex based exceptions under the Equality Act which allow for discrimination against the opposite sex in certain circumstances such as rape crisis centres, refuges, prisons, some sports, etc given a lack of clarity over what “Sex” is.
Adam, may now say he is Eve and claim he has the right to go wherever the original Eve tries to go to hide or be protected. But under the fig leaf he is still Adam.
Eve may say she is Adam, but find herself pregnant, and not be given her maternity rights because legally she is Adam.
There are many repercussions.
Please sign and share this petition to Parliament to update the Equality Act to make clear the characteristic “Sex” is biological, not sex as modified by a Gender Recognition Certificate.
