In the time since the Equality Act 2010 was passed, that fundamental aspect of life, “Sex”, meaning a man or a woman - a male of any age or a female of any age - which is one of the protected characteristics of the Act - has lost clarity of meaning.
It has been confounded by the idea that “sex” is Gender Reassignment ( a man with lipstick, a woman with short hair); or “legally” a man with “sex female” on their birth certificate, or a woman with “sex male” on their birth certificate, thanks to a Gender Recognition Certificate.
In no cases is surgery necessary. In fact few men who identify as woman have undergone surgery. A man can be a rapist and yet be considered a woman.
Though the Equality Act sets out to protect nine characteristics one of which is “Sex” from discrimination, it allows for discrimination in some cases.
For example it allows for sex discrimination to allow single sex spaces for women’s rape crisis centres, refuges, prisons, some sports, changing rooms, lavatories, and schools.
The problem is that organisations or associations offering these provisions are open to, or fear of discrimination litigation because ‘legal’ sex from a GRC, or even assumed due to Gender Reassigment, may count as being as important as biological sex. As “Sex” is not specifically clarified as being biological* it can in practice count as less important.
There was the case of a woman in Brighton who was attending a rape counselling group which was joined by a woman who was very clearly a man. She, the biological woman, was the one who ended up with no option but to leave. Meanwhile the man who felt he was a woman had had two other alternative sources of help on offer at the centre.
Take men who say they are women housed women’s prisons.
Take the two women MPs in Wales, who are outraged at the decision by a rugby association that male rugby players identifying as women are barred from women’s rugby, even though this is obviously on grounds of the biological women’s safety.
Or, the 11 year old boy who’d just joined his high school - who was told by the unqualified drag queen hired to teach the children sex, such as anal sex, that there are 73 genders - and who was sent out of the class for “ upsetting me” [the DQ] for politely saying there are only two genders.
Gay people are affected too. The right to describe homosexuality as same sex attraction is in question. See for example the OED App definition for homosexuality which says same sex, or gender, attraction.
Or think of a gay man suing for dismissal on grounds of discrimination only to fail because his organisation can say they have another ‘legal’ gay man ( a biological woman) working for them. Or vice versa.
Various laws are in conflict and the fundamental, material existence of biological sex has lost out.
Please sign this petition to Parliament, which guarantees your privacy, to update the Equality Act to make clear the characteristic “sex” is biological, not sex as modified by a Gender Recognition Certificate, ( and not Gender Reassignment which often stands in for it).

Ignore the Gov. response to the petition so far, which is on the site, saying sex based spaces are already permitted. This does not address the lack of clarity in the law or the resulting on-going issues.
Know that transactivists launched a counter petition to this one precisely because ambiguity about what sex means suits their agenda to dominate over women, and to discount women’s needs.
