I've just read the email that I got sent this morning by them, the last bit about no contracts etc is a blatant lie then and my OH says them basing themselves in Gibraltar means they don't have to be on Company's House here and to check the Gibraltar register comes with a fee. They're definitely trying evade all the regulations over here

Surely that last paragraph would negate any T&C's that they choose to hide behind. If they are clearly stipulating on their official page that there are no cancelleations fees etc, then that in itself woudl be sufficient to break any contractual obligations.

My OH reckons that the final part of the email could mean that a judge / court would overturn C&F terms and conditions but it would need a bot to be brave enough to stand up to C&F and refuse to pay and take them to court which will probably be extremely unlikely. He thinks C&F are utter scumbags and agrees that it's utterly depressing that so many people will be drained of money by them.
Regarding the earlier intellectual property post then he said it's completely misleading, confusing and makes no sense and again a judge would laugh it out of court but it's probably enough to scare a bot into silence / continuing to pay their monthly fee

So yes, it's a scam. They don't have a legal leg to stand on to enforce repeated payments on victims drawn in on the pretence that it's a one off.

However, they have chosen victims who are ill-equipped to stand up for themselves when Fierce Scam's 'legal enforcement team' (the real driver of the 'biznis') starts threatening them with late payment fees, bailiffs, small claims court, interest etc. should they be unable or unwilling to remain...

I think you've summed the whole scam up perfectly and it'll sadly see a lot of people desperate to leave but being frightened into remaining silent and continuing to pay

Well, for it to come to bailiffs, there would have had to be a court case against the non-payer, which they would have to lose, and then not pay as directed by the court for an enforcement order to be put in place.

Regardless of their apparent willingness to threaten action in the small claims court, I'm sure Fierce's family and in-laws legal team are less likely to want to reach that point, as any court case could well expose the scammy flimsy nature of their claim that the victim had willingly and knowingly entered into a contract to pay the full amount (just showing the last part of the email to the court may be enough for it to get thrown out). They are banking on the victims being too intimidated by the threats and bluster and coughing up.

I wonder if any of the anti-MLM /scam facebook pages, websites, journalists etc will pick this up and investigate or get their legal team on the case.

I can't believe Castle is doing this, well I can but you know what I mean, it's an outright scam, people like Nurse need to find what is missing in their life, not sign up in the hope of belonging and becoming besties with Castle, I thought Yawn was bad but at least she's scamming legally if that makes sense..

I disappeared into a google rabbit hole and came across the chairman’s bonus list for 2016 ( I think) the year Castle had the $400k cheque. Fierce’s cheque was for $6k the same year. I suspect that Castle may be being scammed aswell. Also stumbled on some active coaching sites (plural) still being run by Fierce and her DH. So much for walking away from all her other businesses.
when going into a business partnership it pays to do your due diligence.

It had crossed my mind that Castle might be being scammed too or, at the very least, be being used by Fierce, (who won't give two hoots about her at the end of the day as long as she's lined her own pockets).

Castle's not innocent by any means but I think she's a bit naïve in some ways (partly through not being very bright, partly due to her sense of entitlement and the fact she's probably spent her life being bailed out by family and friends and is seemingly incapable of carrying anything through).

I think Castle will regret this partnership especially as she's well and truly burned her bridges with FL.

When it goes tits up what will she have left?

I don't think Castle is necessarily unaware that Fierce has other coaching irons in the fire. At the end of the day, it's Fierce's 'enforcement team' that she needs. Doesn't really matter if they're also doing dirty work elsewhere.
The deal is 'I bring the cash cows to te parlour, you muscle milks them'...

About the small print saying you're liable for the lot if you bail. There's a few minions desperately trying to reassure 'oh, but they said in the live you could, no contract, blah blah', and desperately trying to get Fierce or Castle to confirm.
