Judge: there is indication from case law that unwise to attempt to confirm diagnosis without guidance of experts.

LookingThroughTheFog · 14/05/2014 09:13

The recapping is annoying me. It's like she has a legal procedure that needs to be followed to the letter, and isn't just there for my personal entertainment.

Judge: effect of Vorster evidence is to create doubt about whether OP has another defense, related to diminished capacity

Masipa: Vorster’s report, no matter how inclusive, cannot replace a proper enquiry. Also only had 2 interviews with OP of unknown duration.

Roussette · 14/05/2014 09:16

Is she? The phone keeps going and I am not getting the drift.

OP posts:
voiceofgodot · 14/05/2014 09:16

Sounds like she's going for it. Crikey.

voiceofgodot · 14/05/2014 09:17

Roussette - Telegraph have a good feed of what's being said, also BB's Twitter.

Roussette · 14/05/2014 09:17

Very true. She says, it's not a matter of anyone's convenience, it's a matter of justice.

OP posts:
LookingThroughTheFog · 14/05/2014 09:17

'This isn't about convenience, but about whether justice has been served.'

AnyaKnowIt · 14/05/2014 09:17

She has

member · 14/05/2014 09:19

Not about convenience but whether justice has been served (re the delay)
but specific order to be handed down next Tuesday

LookingThroughTheFog · 14/05/2014 09:19

Yep. Roux is mentioning outpatient. They will make the recommendations about how this will proceed by Tuesday of next week.

LookingThroughTheFog · 14/05/2014 09:20

She has also said it's not about punishment, and outpatient care might well be appropriate.

Roussette · 14/05/2014 09:20

So is this going to be days or weeks? Why adjourn till Tuesday? What's happening then? (sorry if I missed it - damn phone)

OP posts:
member · 14/05/2014 09:20

Judge: aim of referral is not to punish accused twice, it would be preferable if he was outpatient - adjourned till 9.30 Tues

LookingThroughTheFog · 14/05/2014 09:21

On Tuesday they'll have a full plan of where he'll go when, and who he'll see, and how long it will take.

LookingThroughTheFog · 14/05/2014 09:21

So from what I can tell, he's not going from court to a psychiatric hospital now.

AnyaKnowIt · 14/05/2014 09:22

Well, if I was op I would be sacking my legal team

voiceofgodot · 14/05/2014 09:25

Why Anya? From what I can tell of the Judge's verdict, the assessment is all about determining if he had diminished responsibility due to mental illness and whether or not that gives him another defence. I honestly can't see how this is bad for OP.

member · 14/05/2014 09:26

Been mentioned on Twitter a lot how State Mental Hospitals in South Africa terrible places, someone said worse than prison. Judge's comment about "punishment" would seem to support. Observation as OP may happen quicker than if bed required as average wait for bed is months.

AnyaKnowIt · 14/05/2014 09:26

Because it was his legal team that lead to this.

bobblewobble · 14/05/2014 09:30

It could turn out that he gets found not guilty due to diminished responsibility and do no time in prison. I'm sure he will be happier with that than having a long spell in prison?

member · 14/05/2014 09:31

Wonder if Nel will push for inpatient status to ensure most thorough evaluation of all activities of daily living.
