I can quite see why solicitors would take that view, with out without capital all mc/Macs would be listed together. While legally they don't see the difference I would think the correct grammar is that the name following Mc/Mac should have a capital, Son of Bob, MacBob, Bob is still a proper noun and should have a capital!
