Counter argument filed on '1st Amendment grounds' re the protective order request.

In other courtrooms,

Judge has tossed Doofus' defamation suit against E Jean Carroll. Judge ruled that "Trump has not proven that Carroll’s statements on CNN ..... were false or “not at least substantially true”".

Today's Aileen Cannon ruling re the 'propriety' of using an 'out of district' Grand Jury to determine indictments. I don't know enough to understand if and/or why that may be, but this is a bad thing for the prosecution. But both Joyce Vance and Andrew Weissmann seem to indicate her ruling is questionable.

Trump argues against more restrictive rules over evidence in 2020 election interference case | CNN Politics

Former President Donald Trump’s legal team has proposed more lax rules than those sought by prosecutors over what he can do with evidence he is provided in the criminal election interference case.

At the simplest level, the way dh (who lived in the States for a few years) described it to me, is that the "Draft picks" is when the big teams (eg the Red Sox or the Evil Empire Yankees in baseball) take it in turns to pick who they want from the college leagues/lower leagues before the new season starts.

Well, I have discovered the reason he thinks she should be recused:
"Trump has also demanded the recusal of D.C. District Judge Tanya Chutkan, on the grounds that she has also presided over trials of January 6 riot defendants, which have touched on his own actions."

So he is admitting that his own actions are somehow tied in with the January 6 riot defendants who have been found guilty of various crimes. Doesn't that taint him by association?

Pretty much EVERY DC judge will have presided over Jan 6th Trials!
I like your legal thinking that he is saying he was bound up in the riots

I guess he has to give SOME reason for recusal and realises that "Judge isn't Aileen Cannon" is too transparent a reason.
In other news, an Alpine glacier has just been clocked moving faster than Judge Cannon

BruceAndNosh · 08/08/2023 21:07

And so it continues....
Judge Chutkan asked both sets of Lawyers to agree a time for a hearing with her on on before THIS Friday.
Jack Smith - we can do anytime Wednesday Thursday or Friday.
Trump's team - We can do Monday or Tuesday next week.
FFS!

DuncinToffee · 11/08/2023 16:36

Judge Chutkan says Trump has free speech rights, but his campaign will have to "yield to the orderly administration of justice."

"If that means that he can't say exactly what he wants to say about people who may be witnesses in this case, that's how it's going to have to be." @NBCNews

AcrossthePond55 · 11/08/2023 16:58

Judge agrees with prosecution team re the protective order. From the article:

"US District Judge Tanya Chutkan said she would adopt rules proposed by prosecutors to limit who on Donald Trump’s team can access the evidence in the 2020 election interference case, rejecting the former president’s request that the language be broadened so that volunteers and other people not directly employed by the defense team could also review discovery."

https://www.cnn.com/politics/live-news/trump-probes-latest-news-08-11-23/index.html

Got that so far? Ok...Here's Fox's take on it:

"The federal judge assigned to Donald Trump's 2020 election case has largely sided with Trump's defense attorneys on a protective order over evidence, but handed prosecutors a win by broadening which material is considered "sensitive" and should be protected."

So basically the prosecution getting what they want somehow gets turned into a 'win' for Doofus? Oooookaaaay.

Grin treating him like a toddler

Judge Chutkan rules Trump will be forbidden from having a phone, copy machine, or anything else that could create a copy of the sensitive materials while he's reviewing them.

Defense counsel will have to review Trump's notes to make sure he's not copying witness' personal info.

Just a sudden gross and disgusting thought. I can just see him cramming documents down his pants and trying to smuggle them out.

The official who has to check for that should get hazardous duty pay.

In reality, 50% chance that he 'accidentally' lets a name slip during one of his mostly incoherent ramblings. 50% chance that he 'technically' abides by the ruling but makes lots of hints and innuendos as to 'who tattled what'. Because there is no way he's going to meekly adhere to the judges ruling. And once the cat's been let out of the bag, the damage is done.

No problem. But @TheSilveryPussycat really nailed it. He's BOTH!!

@BruceAndNosh

OMG, the hurricane chart!! I forgotten all about that! Yes, I can see him scribbling all over the documents and/or making changes like the 'criminal toddler' he is.

AT LAST! What a relief! If this doesn't stick and he's not jailed, I will give up on the world. But I wouldn't be surprised if he still got away with it, somehow, as I haven't recovered from "Grab 'em by the pussy.." not killing his Presidential hopes in one fell swoop.

That last post was me!

DuncinToffee · 15/08/2023 07:59

I saw this

Worth remembering tonight:

1) state crimes can’t be pardoned by a president in DC
2) in Georgia, even the GOP governor lacks the power to pardon

Oh and just for fun:

3) trials are televised in Georgia

BruceAndNosh · 15/08/2023 08:11

I wasn't sure expecting this Monday, since much had been made of witnesses being called before Grand Jury Tuesday (today)
Interesting that Mark Meadows is indicted, there was a lot of speculation that he'd flipped.

DuncinToffee · 15/08/2023 08:37

Those indicted in Georgia:

Donald Trump
Rudy Giuliani, Trump lawyer
Mark Meadows, White House chief of staff
John Eastman, Trump lawyer
Kenneth Chesebro, pro-Trump lawyer
Jeffrey Clark, top Justice Department official
Jenna Ellis, Trump campaign lawyer
Robert Cheeley, lawyer who promoted fraud claims
Mike Roman, Trump campaign official
David Shafer, Georgia GOP chair and fake elector
Shawn Still, fake GOP elector
Stephen Lee, pastor tied to intimidation of election workers
Harrison Floyd, leader of Black Voices for Trump
Trevian Kutti, publicist tied to intimidation of election workers
Sidney Powell, Trump campaign lawyer
Cathy Latham, fake GOP elector tied to Coffee County breach
Scott Hall, tied to Coffee County election system breach
Misty Hampton, Coffee County elections supervisor
Ray Smith

prettybird · 15/08/2023 08:50

His gaslighting is beyond the scale. Shock

How can he try to dismiss the charges in Georgia by saying it is "an overwhelmingly Democrat state" ? Confused

It has a Republican Governor. A Republican Senate. A Republican Secretary of State. A Republican House of Representatives. Confused

Yes, its two senators are currently Democrat but that's about it in terms of elected positions.
