Have I been scammed with these clothes

Okay so I was a bit careless and decided to get my ds some gym wear from a known retailer based in the UK so I googled the name and it took me to the website and I placed an order for a top and trousers.
After placing the order I realised I had ordered from a website in America not ideal but just thought that it was the American website and same stuff it was bearing all the same logos and prices where in sterling.
The stuff has arrived and the trousers although similar to what I ordered have a completely different logo to the front and are missing the one logo off the back, the top is completely different to what I ordered.
Ds already has some of this named sportswear which he bought from within the UK and the logos although very similar dont quite match the clothes also dont bear the name inside on any labels and there was also no price labels on them either and no paperwork accompanying them.
I have been in touch with this company and showed them what I recieved and what I ordered and they apologised but are desperately trying to get me to keep the clothes and take a 10% refund.
What would you do because I have asked for free return and full refund but I'm going back and forwards.

Tell them your final request is a free return and full refund and Threaten them with trading standards if they don’t agree .
Have you googled for reviews of the website to see if anyone else has has the same issues ?

It sounds like you might have been scammed. If the website is based in America they may not be subject to the uks consumer laws so it will be worth checking the terms and conditions of the sale to see what your return options are. You can also check with you payment provider- credit card etc to see if you have any come back with them.

If you link to the website we can probably tell you if it’s legit or not? Are you concerned that they are fake or just not exactly what you ordered?

If they are based in the UK you can report them to trading standards via citizens advice on this number- 08082231133.

Obviously based in America so cant get any help this end. I cant fathom out how I ended up on there the clothing brand I refer to is gymshark which my ds really likes and this company I have discovered goes by the name gymyellowclothes.com and thier stuff is practically identical.

They have a weird way of talking telling me the clothes are nice and good and I can sell them or give to somebody lol

Gymshark are a UK company, based in Birmingham I think. They have a USA website but the company itself is UK. Their customer service is very active on Twitter, so if you have an account I'd try there. If not, they have a UK phone number.

How could you not notice you were on an entirely different website to the one you wanted? Surely the address would give it away instantly. Sorry OP but this is on you I think. You haven't been scammed, but you have been very careless.

There have been many cases of fake Gymshark copy websites using false Facebook ads etc to scam customers into buying their fake goods. The company work hard to deal with this but as soon as they have one shut down another takes it’s place.

I’m sorry that you have been a victim of this. I’m not sure what you can do now but I would report the site to Gymshark and they may be able to have it removed.

@LuaDipa it doesn't matter if it's a fake Facebook ad or a rogue Google search result masquerading as another company, surely you check you're in the right place before giving them your card details? It's so very easy to see if it's a dodgy website trying to pass itself off as another brand. The URLs in this case are totally different! gymshark vs gymyellowclothes!

It's sneaky underhand tactics but they can only get away with it if people are too eager to believe they're getting a bargain.

If it's too good to be true it almost certainly is. Check you're buying from the right web address!

I think you can try to push for a refund but I suspect you will send it back and not get a refund and lose all ways round. Chalk it up to experience.

Even if this were a UK based company, how would that help the OP in anyway?
By all means, report them so it builds up evidence against them and they may be stopped from trading but dont expect to get any individual help. They dont do that.

Number 1) You cannot report directly to trading standards. You can call the consumer advice helpline and explain the situation to them. They may or may not offer you practical advice. They may or may not refer the matter to trading standards.

Number 2) Trading standards do not deal with individuals cases. They will not call a company up and get a refund for an individual customer or whatever it is you want. Trading standards act by shutting places down, finding them etc. And they only do that if there are several complaints about a company. They dont do anything to actually help individuals. Reporting to trading standards does not get you anything; no help. It will add evidence to any case against the company which is very helpful in having rogue traders shut down, but it doesnt help you on an individual level.

Be very firm with them set out what you ordered, what you got and what you want to happen. Give them a date and tell them if they don't comply you'll be taking up with Gymshark as they seem to be impersonating them, you will take up with trading standards and (if you used your credit card) you will be asking your bank to make a chargeback.

We think it will be a Chinese company selling fake Gymshark clothing (your post saying they have an odd way of expressing themselves adds weight to that tbh).

You can state that you want a full refund but I can't see them wanting to comply with that frankly. I think you'll have to chalk it up to experience and check the sites you go on are legitimate before you commit to ordering.
