Have I been scammed with these clothes

Okay so I was a bit careless and decided to get my ds some gym wear from a known retailer based in the UK so I googled the name and it took me to the website and I placed an order for a top and trousers.
After placing the order I realised I had ordered from a website in America not ideal but just thought that it was the American website and same stuff it was bearing all the same logos and prices where in sterling.
The stuff has arrived and the trousers although similar to what I ordered have a completely different logo to the front and are missing the one logo off the back, the top is completely different to what I ordered.
Ds already has some of this named sportswear which he bought from within the UK and the logos although very similar dont quite match the clothes also dont bear the name inside on any labels and there was also no price labels on them either and no paperwork accompanying them.
I have been in touch with this company and showed them what I recieved and what I ordered and they apologised but are desperately trying to get me to keep the clothes and take a 10% refund.
What would you do because I have asked for free return and full refund but I'm going back and forwards.

Might not be left with much of a refund by the time they take off all their fees!

If you want to return your item(s), please contact our customer service team within three days when you received them. Please provide your name and order email when contacting our customer service. All return items must keep their original condition, they most not worn, altered or washed, with all tags attached. And you have to pay restocking fee, shipping fee and handling fee.

Oh for goodness sake. That's not even a similar name. You've googled for something and then clicked on a completely different name. The website doeant have half the stuff you would see on a genuine retailers site. It's totally not the same brand.

You may need to just hold your hands up and accept that you've been an idiot here, and next time actually look at the bloody links you click on.

That’s not a US-based website, it’s clearly Chinese. The way they phrase things on the “about us” page and the the fact that I can’t find a physical address for them anywhere on the website...it’s yet another Chinese website selling fake label goods. There are a lot of negative reviews about them online - in fact, I can’t find a single positive one.

Sorry to hear you’ve been scammed but a little research on your part would have prevented that. That website has “fake” written all over it.

Their returns policy is no where near close to UK consumer regulations. And the grammar? Clearly a scam site.

I really think that people who fall for this sort of stuff just need to accept it. International safety and online shopping safety are not new things; we are all well aware of what to check for when shopping online.

Do they claim to be in the US? Their website is registered in Panama (not unusual when you don't want to be traced), and the people you're speaking to could be absolutely anywhere.

I'm sorry you got caught out, but it's a harsh lesson not to buy in haste.

Something similar happened to me recently. I ordered a winter coat from an ad on FB (I'm never naive about scams, so really kicked myself on this one!) but never received it. Looked at my PayPal account and credit card - saw two diff company names listed (both foreign names). Sent an email to the company about when I would get my coat. The reply in very bad English was along the lines of "please be patient, you will get it soon". Left it a few days, then went to email again, but this time the messge bounced back. And the website I ordered from no longer existed.

I contacted PayPal, who opened a case. When that failed (unfortunately I chose unauthorised use of credit card instead of fraud), I contacted AmEx - they also opened a case and have reimbursed me fully. I opened the case under Fraud. Might be worth a shot in your case. You can document the difference between the ordered goods and the ones you received, as well as screenshots of any correspondence, to support your case. I ordered my brother some clothing off Gymshark as I usually do, this time I too got taken to a diff site and I would’ve easily done the same if not concentrating - it is very cleverly done - all it takes is a moment of distraction and I’d prob have done the same ! Absolute scammers!

Well I shall be bloody careful next time never expected this to happen no need to call me an idiot though.
I googled gymshark and link for this site came up I never saw the name gymyellowclothes whilst on there but it was all in the order details afterwards. They obviously avoid letting on that they are gymyellowclothes until you've handed your money over.

I was taken in by one of these fake sites that sent a load of really poor quality clothes nothing like advertised. After going back and for with them making all sorts of excuses not to refund I stopped engaging with them and put in a dispute with paypal (hopefully you paid this way or by credit card) showing the correspondence already had and paypal gave me a full refund.

I would try that. If you paid by credit card your credit card company should give a full refund.

how did you pay. You can go through your credit card provider and are legally protected if the payment is over £100

This happened to me with a different company. I had no idea until I had placed the order that it wasn't the correct company and although I thought it came from America, it didn't. It was a Chinese company. They admitted they had sent me a completely different item than the one I ordered and told me to return the goods at my own cost (£30). I made a huge fuss and they offered me a 20% refund. I stick to my guns. I contacted my bank but as it was £98 they would not assist - it has to be over 100. I argued with the company for nearly 2 months. In the end I got absolutely nothing. No refund, no correct items. I was incredibly frustrated and angry. I just hope you have better luck. I always check the website addresses very carefully and will not buy direct from abroad.

How did you pay?

Was it debit or credit card? Was it PayPal? A few of these are protected.

Oh what a shame. I think you will end up having to write it off. They are probably Chinese based as the language and tone of the ts and cs is very similar to the company I dealt with. I was lucky to get my money back and could have kicked myself for not checking it out better first. I always now pay by CC or paypal for anything on the internet.

That's really unfortunate, it's a shame you didn't look at the companies website name but I bet you will now. I just googled and I can how they've tried to copy the actual gymshark advert so if you're just doing things quickly and not familiar with the brand itself then I can see how you maybe scammed.
It's not just you who has, there's quite a view when looking on that trust review link posted earlier. I know that probably doesn't make you feel Better though Sad

The name in the address bar which would have bee very clearly visible on your screen was your first clue. Your second clue was the spelling and grammar in the site. Your third clue was the refund policy. Your fourth clue was the lack of address (a legal requirement on sites selling in the UK). Thise are just the first things which you always check when you're shopping on a site for the first time. You had many reasons to think it was a fake site.

You were looking for a site with a totally different name.

Just an FYI. Always pay by credit card. Or PayPal. Those are fab at chargebacks. Plus they give you protection if you get scammed

I brought a handbag from a French company. Oh my gosh. They were horrific. I spent a year trying to get back my money on a broken bag. Once I googled. It came back that they are a well know company which sends out broken goods. Some lady brought over 10,000 people Worth of stuff.

the problem is, you can google something, and the actual site you want,. be several links down the page. You do have to be careful.
If they have deliberatly tried to pass themselves off as gymshark, then its a scam, and their logo makes me think they have, but since theyre in the US, im not sure what you can do about it

However. Ring your back. Explain what’s happened and that you think you were scammed. Some do help.
