Have I been scammed with these clothes

Okay so I was a bit careless and decided to get my ds some gym wear from a known retailer based in the UK so I googled the name and it took me to the website and I placed an order for a top and trousers.
After placing the order I realised I had ordered from a website in America not ideal but just thought that it was the American website and same stuff it was bearing all the same logos and prices where in sterling.
The stuff has arrived and the trousers although similar to what I ordered have a completely different logo to the front and are missing the one logo off the back, the top is completely different to what I ordered.
Ds already has some of this named sportswear which he bought from within the UK and the logos although very similar dont quite match the clothes also dont bear the name inside on any labels and there was also no price labels on them either and no paperwork accompanying them.
I have been in touch with this company and showed them what I recieved and what I ordered and they apologised but are desperately trying to get me to keep the clothes and take a 10% refund.
What would you do because I have asked for free return and full refund but I'm going back and forwards.

Chinese fake websites. Theyre absolutely fucking rife atm. Especially as facebook adverts. Before you order anything expensive atm, if you arnt a frequent website visitor check how old the website is. If its a few months old and it looks like theyve stolen photos, dont bother.

You might want to cancel your debit card and get it reissued at this point if you gave your card details to this random bunch of charlatans.

You have bought from a fake Chinese site by the sounds of it, we have all done it. Did you pay by credit card?

Never buy from a site that that has the likes of WorldPay and western union as payment options.

In the run up to Christmas we were caught out by a fake adidas site selling Yeezys. It was genuinely indistinguishable from the real adidas site. It wasn't until we noticed that the door number for delivery was wrong and tried to correct it with the vendor but never able to contact them, that we realised. Luckily paid via PayPal so full refund came quite quickly.

I've been scammed like this before. Turns out it was a company in China, I got the same weirdly worded emails from them.

The charity shop did well out of me that day.

As you paid by debit card ask them if you can do a chargeback. It’s not a legal requirement and is dependent on the terms and conditions of the card issuer, but worth looking into.

I never fathom how trustpilot calculated its average review
100% of reviews are one star
The average is 1.6???

I reviewed an organisation in December - their first, one and only review, one star.
The average review displayed as 3.2??Hmm

That said, I do use Trustpilot a fair bit if I am considering using a new company- but it does make Trustpilot itself seem dodgy.

OP, what exactly did you google? "Gymshark"? "Gym Shark sale?"

I ask because I would always people to check very carefully if they've found a site through "Gymshark outlet 2020" or "Gym shark sale".

Oh for goodness sake. That's not even a similar name. You've googled for something and then clicked on a completely different name. The website doeant have half the stuff you would see on a genuine retailers site. It's totally not the same brand.

You may need to just hold your hands up and accept that you've been an idiot here, and next time actually look at the bloody links you click on.

This is how scammers get away with it, not everyone will realise, and that's enough to make them some money.

I've recently had two texts from 'the Halifax' saying that an unauthorised device has tried to access my account, so please click on this link. As I don't have a Halifax account that was never going to work, but if they pepper enough phone numbers some of them will go to people who do. And then some of those people won't spot that the address is Hali-fax, or won't realise the significance. They only need to hit five of those accounts where people do actually give their details to make a good profit.

the link above has a section that says they do get fake websites shut down, so do report it to them.

I don't think you'll get your money back. Unfortunately paying by debit card offers you little to no protection online. Always worth getting a credit card just for online use - you can pay it off each month but it's worthwhile just for the protection it gives.

Never put your card details in without checking the website you're on is safe, secure and what it claims to be. The website names are in no way similar - if you'd checked, you'd have known straight away.

You can do debit card chargeback where the bank refunds the money but if the bank doesn't manage to get the money back from the company then they may debit it back out your account again

This happened to me too OP. Googled Gymshark and went onto a website that looked exactly the same as the genuine Gymshark website.

It was only two weeks later, when the clothes hadn't arrived, that I emailed Gymshark to chase the order and they had no record of it. I then checked my PayPal receipt and the recipient was rcuex.shop.

Gymshark said they were aware of a number of fake Gymshark websites circulating but that there was nothing they could do.

Weirdly some clothes did turn up from the fake website about a week later but they were awful. Stank like petrochemicals and were really weird child like shapes. We had to write it off in the end as that website has since disappeared and others have popped up in their place. There is no way of tracing them.

Yes you've been scammed. You could try your bank but I wouldn't get my hopes up since you did receive your order, albeit not what you hoped.

But you need to double check the link you're clicking on as well. I've just googled "Gymshark" and the page you linked isn't even on the first page of results.

I think unfortunately you need to write this off as a mistake. You may be able to get some money back by selling them on eBay or Marketplace but I wouldn't count on getting much.

I've just googled it again OP and it seems like all the fake websites are not showing up in the google search anymore. They were absolutely rife around Black Friday and before Christmas though.

Even clicking on the "about me" section of the gymyellowclothes site tells you its's not a genuine gymshark page.
