Neighbour stole our woodland?

Our DGrandad left me and my sister his woodland when he passed away a few years ago. It isn't anything that special (as in its not protected and hasn't any distinguished species) but does have a TPO on a couple of trees. It is a place that my sister and I visit occasionally and thought that perhaps we could use it as a place to "wild camp" with the kids this summer for a few weekends. Even had insipiration from what George Clark created in a piece of woodland in his series Amazing Spaces and thought maybe one day with enough money we could do the same.

Anyway, we went down there this weekend to have a look to see if we could maybe clear a patch for a good tent destination, Thought it be good to do this now before everything starts flourishing in the spring.

To our shock it's all been fenced off and there has been some very obvious clearing of trees and shrubs! We knocked on the nearest house to ask what's happened to our woodland and the couple that lived there informed us that they have now taken it as their own and have started keeping it in order for past couple months. They said that it now makes our land legally theirs?

Obviously we shall be seeking legal advice but in the meantime, can what they claim actually be correct?

Just seems so unfair? Surely that would mean I could just fence off any land and claim it as my own?

Shock that's awful I really hope they haven't felled any protected trees. (Felling any is bad enough) I hope you get somewhere with the solicitor

Nothing to add, other than how mind-blowingingly entitled some people seem to be. And what's with the "deeds don't mean anything??? Wtf do they think the deeds actually are, if not proof of ownership?

No they cannot. Take extensive photos of the fence. Write to them demanding they take the fence down and cite your title (grandfather’s evidence he owned it) they will not be able to register it at LR on the basis of 2months adverse possession. Put a sign up stating it is private woodland and not for public use. If it’s unregistered, you should instruct a solicitor to register your title to this woodland. Did you receive documents in the will? There may be a deed of conveyance or at least letters evidencing ownership. A solicitor will be able to advise.

Totally wrong they would have to look after it for 20 years without a challenge and after that time apply to the Land Registry for possessory title who would have to write to you if this application was made - the LR would only grant this if there was no challenge -if I were you I’d call the Land Registry to check if it’s registered or get your solicitors to submit a search of the index map to check this - if it is registered request a copy of the Register and title plan then you can show these people that the land is yours and they are trespassing - advise them to remove their fence and to rectify the damage caused (I.e cutting down trees etc) by their illegal possession.If it’s not already registered you would need the original title deeds to get it registered!

At the front of my property is a largish piece of green field. The green belongs to the house. It seems obvious to me that it's private property as we have a couple of trees, a bench and flower borders. We have now fenced the "green" as we had dog walkers using it as a dog toilet, a couple of cars for sale, a tethered horse and a neighbour had a skip put on it.

Doesn't all land and woods belong to someone? People and their CFuckery never fail to shock me.

I hope you are feeling more confident about your position after the pile of posts here all saying the same thing!

Good luck sorting it out, hopefully the CF-ers will be bright enough to know when they’ve been beaten , & slink off from whence they came.

Thank you Mophead - I'm relieved it wasn't a troll - but I have to admit it was heartbreaking story and in many ways I wish is had been a fantasy. Poor OP

@PanamaPattie we have that problem too. All our front gardens are open so dog walkers take liberties from time to time. We challenged one once, and he said that he thought it was 'public' land so ok to use. Shock Like that makes it ok! But he didn't do it again. I wouldn't mind so much, but they rarely poop and scoop.
