Neighbour stole our woodland?

Our DGrandad left me and my sister his woodland when he passed away a few years ago. It isn't anything that special (as in its not protected and hasn't any distinguished species) but does have a TPO on a couple of trees. It is a place that my sister and I visit occasionally and thought that perhaps we could use it as a place to "wild camp" with the kids this summer for a few weekends. Even had insipiration from what George Clark created in a piece of woodland in his series Amazing Spaces and thought maybe one day with enough money we could do the same.

Anyway, we went down there this weekend to have a look to see if we could maybe clear a patch for a good tent destination, Thought it be good to do this now before everything starts flourishing in the spring.

To our shock it's all been fenced off and there has been some very obvious clearing of trees and shrubs! We knocked on the nearest house to ask what's happened to our woodland and the couple that lived there informed us that they have now taken it as their own and have started keeping it in order for past couple months. They said that it now makes our land legally theirs?

Obviously we shall be seeking legal advice but in the meantime, can what they claim actually be correct?

Just seems so unfair? Surely that would mean I could just fence off any land and claim it as my own?

This thread started on Sunday and it is only Tuesday morning.

This is a person's real life not a soap opera where someone just needs to dream up and write the next line.

OP is going to have to find a solicitor, consult with them and then process. Or they have compose a suitable letter to the CFWoodthieves, AND post it to them. Why would there be an update today? Or even this week??

Go straight to lawyer and get a formal letter sent to them. Then go back and dismantle their fence. CFukery

I think you will find they are in the wrong. You have done the right thing getting legal advice. Let a Solicitor deal with it. Try to remain calm and film any interactions with the people who are trying to steal it. Put up No Trespassing signs and cameras. There are wildlife cameras on Amazon which are good for outdoors like this.
The thieves are evil and nasty but try to keep calm.

Do you have the Deeds for the land? Is there proof with the land registry?
I just ask the obvious and not sure if you already answered it.
12 years of passage over the land can erode a right of way, but if ownership is with a landowner, that's all there is.
There were some lovely allotments in Oxted but no on could ever find the Deeds and they got built on. Sooo DEEDS!

Where in the country are you OP this is happening just along from us we are rural , it's all greenbelt here too with a current ban on building for 10 years i think it is and all houses built by owners. the land was owned by an elderly guy who passed away .

Have they put any signs up at all or named it ? X x

No they cannot. Take extensive photos of the fence. Write to them demanding they take the fence down and cite your title (grandfather’s evidence he owned it) they will not be able to register it at LR on the basis of 2months adverse possession. Put a sign up stating it is private woodland and not for public use. If it’s unregistered, you should instruct a solicitor to register your title to this woodland. Did you receive documents in the will? There may be a deed of conveyance or at least letters evidencing ownership. A solicitor will be able to advise.
