Neighbour stole our woodland?

Our DGrandad left me and my sister his woodland when he passed away a few years ago. It isn't anything that special (as in its not protected and hasn't any distinguished species) but does have a TPO on a couple of trees. It is a place that my sister and I visit occasionally and thought that perhaps we could use it as a place to "wild camp" with the kids this summer for a few weekends. Even had insipiration from what George Clark created in a piece of woodland in his series Amazing Spaces and thought maybe one day with enough money we could do the same.

Anyway, we went down there this weekend to have a look to see if we could maybe clear a patch for a good tent destination, Thought it be good to do this now before everything starts flourishing in the spring.

To our shock it's all been fenced off and there has been some very obvious clearing of trees and shrubs! We knocked on the nearest house to ask what's happened to our woodland and the couple that lived there informed us that they have now taken it as their own and have started keeping it in order for past couple months. They said that it now makes our land legally theirs?

Obviously we shall be seeking legal advice but in the meantime, can what they claim actually be correct?

Just seems so unfair? Surely that would mean I could just fence off any land and claim it as my own?

They are trying to establish adverse possession op. It's easy to knocked on the head

As with pp solicitors letter and remove fence. You need to establish own fence and lock entrances putting keep out signs on it

Looking forward to the updates - our neighbours tried this with the previous owner of our land. They said they had been maintaining it for two years. They lost the case had to give the land back and pay costs. You have the law in your side here OP

I'd suggest as well as your planned actions, get some motion sensor CCTV cameras installed that you can monitor from a distance

Was it ever actually proven that the patio doors threads were all a troll? Becuase I don't think it was. I know a few people called troll, and I wonder if the idea just ran from there. IIRC, the last update basically said that she wasn't posting anymore due to legal stuff, and I'm sure i recall at least one MNHQ comment along the lines that there wasn't anything to prove troll.

OP, as far as your problem goes, don't DIY. You should be able to claim costs, so straight to a solicitor (as you've said you're doing) and follow their advice, don't try to be nice as it could backfire on you.

Lots of people called troll on the SpanGran threads. MNHQ maintained that it was not a troll.

As far as I'm aware, the poster was genuine.

I don't think SpanGran was a troll, just a person who accepted a lot of support from us when it was first going on, especially the cheerful tongue in cheek suggestions, but in the end decided it would be safer from a legal point of view to go back under the radar. As a regular poster on her threads I saw messages from HQ that indicated that they had no reason to suspect her of trolling.

Meanwhile for CheekyFuckerFest 2019 I will be happy to contribute a a workshop in the Kid's Arena making Artisan Scotch Eggs Wink

OP, obviously you're not going to have an update until after you've seen a solicitor, but in the meantime, I'd like to echo others who have suggested that you go down, making your presence known and taking photos of the fence, etc. The other suggestions for collecting evidence, eg Google Earth, deeds, evidence of you/your sister visiting the woodland, and so on, are good too. The more evidence you have, the better.

WRT Spangran, once upon a time you could sometimes see whereabouts a photo uploaded to MN was taken. They've stripped all that info out now.

My parents accidentally stole council land once. Or rather the previous owners of our house did, and then after we'd moved in the council suddenly noticed that the last metre or so of our garden was actually supposed to be pavement (we were the end house on a cul de sac so it wasn't obvious just by looking). Because my parents are not unhinged they just apologised and moved the fence back to where it was supposed to be rather than doubling down and attempting to claim some sort of half-arsed knowledge of adverse possession.

Well they're certainly currently at number 1 on the MN cheeky fuckery charts 2019 - I know it's early in the year but I am confident it will hold its place for a good while.

I know sweet fuck all about owning land - but will happily contribute to and attend CheekyFuckerFest - I'm pretty good on the decks so could facilitate dancefloor shape cutting Glitterball
