That was important far beyond the hook of Senator Whitehouse calling the judicial nominees ridiculous.
He takes the nominees through the laws relating to utterances of threats; they all agree that there are specific legal doctrines which can assign responsibility to people behind the person who utters the threat (solicitation, conspiracy, RICO).
Then he tells them that the US Marshall Service, which is supposed to deal with threats to federal judges and whose job it is to investigate behind the utterer (where evidence justifies), has in over a dozen cases refused to answer Yes or No when asked whether it will in fact investigate the people behind the utterer.
