Adult disability payment

Looking for advice on this benefit.
I applied for this just over 2 months ago, I sent 3 forms of proof of illness and had a video call appointment to confirm identity.
I called social security Scotland to check my process of claim and they say it’s awaiting a case manager.
Does anyone know how long I’ll be waiting for a decision?
Seems a very long, drawn out process.

Thanks all 😊 Nobody called me back today, as I suspected. Ill look into things on Monday again and look into Voiceability as suggested. It hasn’t been the best process, one issue to the next. I hope it comes to a conclusion soon, especially since it’s approaching the 11 months mark from my date of application. Appreciate everyone’s help 🥰

I applied on the 28th of November last year and only just got it settled 2 weeks ago.

They declined it in June, sent the redetermination right back and jf you scroll up, you'll see the letter I got along with another redetermination form that would go to tribunal as they missed the 56 day deadline. I filled the new redetermination form in (through gritted teeth, they are horrible forms to fill in) Sent it away and literally a few days after got a phone call asking if I wanted to extend the original redetermination (im getting sick of typing that word now lol), which I did because if you go straight to tribunal after that, rhats your last go, at least this way I still had the tribunal to try if it failed too.

2 weeks later got my award letter but there was no mention of the backdated amount on it, so as a result of that the backdated amount took 3 weeks to come through. I got awarded no mobility, which I want to challenge but I genuinely don't have the energy for that after arguing and fighting tooth and nail for a year. Awful process. They really need to do something cause that was honestly soul-destroying.

Hi, I’m in the same boat . My son had dla since diagnosed with autism at 5yr stopped when he was 13 . Applied again and got refused appealed and got told no. He is 18 and really struggling so I have applied again . They keep phoning him and he’s missing calls . So I’m going to ask they contact me . It’s ridiculous

My adult DS was only diagnosed autistic a year ago and his main issue is communicating including selective mutism. This is on the application as well as in the attached evidence and yet they still kept trying to phone him during the process. He was able to confirm that he was happy for me to speak on his behalf and they noted it on the file for 3 months which made it easier.

It's also relevant to mobility as although he is intelligent and also able to drive, there are no circumstances in which he'd be able to ask for help if he was lost or a train was cancelled etc. He also needs to meticulously plan if he needs to drive somewhere he's never driven before. In fact he rarely drives outside a 3 mile radius of home.

Hi,

(Update from earlier posts) put in for my redetermination on the 20th October via phone, I also requested to be sent all the information that they had, on which they based their decision on 177 pages! 🫣however, I believe there are duplicates/triplicates within the page count! Contacted SSS today, via web chat to ask, if there was any progress on the redetermination was informed that’s in the hands of CM! Still no further forward and I’m half way through the 56 day mark, I have also uploaded more supporting information too. Oh well just have to wait and see what happens next!

I’m still waiting on a reply to my redetermination. Case is still open is the update I had yesterday over the phone. I got my letter 31st October saying they didn’t meet their obligation of completing my redetermination in the 56 days and I called them and they extended the redetermination. I’m now worried I’ll miss the 31 days from the 31st October to appeal. I’m hoping to hear this week or I’ll be submitting my appeal anyway. This has been going on since I submitted my application on the 5th January 2023.

Understanding a review decision

A new decision following a review is called a determination.
When Social Security Scotland confirm that they will make changes to your Adult Disability Payment, they'll let you know:

If the award will stop, reduce or increase following a review, Social Security Scotland will tell you why.

Indefinite awardsYou may be given an indefinite award if:

  • your needs are highly unlikely to change
  • you're awarded the enhanced rate of both the daily living and mobility components of Adult Disability Payment
This means your award will not be reviewed in the future unless you tell us that something has changed……. This is off of the website…hope it helps 🌷

Still waiting….. I was told my letter was being sent on Thursday/Friday of last week. Hoping it arrives today. How is everyone else getting on? Any updates

I am still waiting I applied beginning of February last update was information had been received from my GP and the case worker was looking through the information and when a decision had been made I would receive a letter really just need the waiting to end I did at least get an apology for the length of time I have been waiting.

Hopefully not much longer for you also. I applied first week in January. I was told last week that the chap dealing with my application was speaking with an in house medical trained colleague on Thursday and that I should receive my decision letter this week. It’s been one thing to the next and I really just want to know now! I’ve been told I won’t lose my right to appeal while I wait.

Still no reply or letter received like they said I would receive this week. I’ve called and the letter hasn’t even been issued yet and my case is still open! I’ve told them I’m making a formal complaint now. I applied in January and due to errors at their end my case wasn’t picked up until I called to progress chase in April/May time. I’m now 29 days over my 56 day redetermination deadline and every time I call I get told something different. I’m waiting on a manager calling me back and I’m going to raise a complaint. Anyone else experienced this? Having this hanging over me for so long is taking it’s toll

Hi I have been reading this thread.
I was up for a review last month phoned them on Friday, told them I have no changes in my health so I didn’t have to fill in the form again. Has anyone had a review from them that hasn’t changed anything and been awarded?
just wondering how long this will all take as I had to go through the tribunal for pip but was awarded low rate mobility and care so I’m hoping that I don’t have to go through all that again with ADP.

I’ve still not received any letter. Called today to be told my outcome letter was issued 30/11. I still haven’t received it yet so unsure of my outcome. Have I been declined if no payment is in my bank today 5/12? When did everyone else receive their first payment after outcome letter was issued? Thanks

@@Wizwiz some people receive a payment before and some receive it after they have received the letter so it is hard to know either way hopefully you will receive some good news soon

I had a call from my case manager yesterday due to lack of supporting evidence and receiving no information from my GP he wanted some more information before speaking to the in house practitioners.

Kept going on about having no anxiety diagnosis in my case the anxiety is a symptom it is not the diagnosis really hard to explain this to people.

I am not holding out much hope of receiving a favourable outcome any time soon if at all😞

@Wizwiz @Allyballybee445 🤞that you hear soon, I contacted them yesterday via Webchat, I was told that they have a backlog re-determinations to get through my 56th day is up on the 14th December, the chap had informed me that my application has been picked up and was being looked at by Case Manager and in the proper queue🤷🏼‍♀️! He said that they are working tirelessly to have the redeterminations that are in date order completed within the 56 days, if I haven’t heard anything by next Wednesday I will contact via phone!

@Piseag123 i wouldn’t hold your breath. I’ve been told everything for the last few weeks. They kept telling me my outcome letter would be with me by bla date and it never came. Think that happened about 3-4 times and when I called it was still open with no decision made. Was promised a call back from a manager within 48 hours and never got that either! My redetermination was at its 56 days on 31st October. Let’s see if my letter arrives soon like they’ve said this time! 11 months since I first applied.
Really appreciate everyone’s help and input ❤️

Just spent 1hr 15 on web chat after waiting 45mins for someone to answer the phone. The woman barely spoke English so I told her it's pointless speaking with her. Went on webchat.

They received my appeal 20 November. It's still with the appeal team. I asked if they have sent my file to the tribunal people she said yes we have completed that part.
So I asked for evidence since they have 7 working days to send my file. She made me wait 30mins to tell me the appeal team have my appeal but they have a massive backlog so they haven't managed to send my file yet and hope to do it in the next week.

So I said that's another time you've just lied to me and another time you've failed to follow your own process as it's in the the appeal process you have to adhere that it will be completed within 7 working days and the client will be notified when this has been completed, yet I'm on the phone and chat. She Then asked if theres anything else she can help with and completely dismissed what I had said lol they're absolutely shocking.

She did tell me that once they've sent the appeal package, the tribunal people give sss 31 days to respond to my appeal with their reasons. Then they'll decide if and when I get a hearing or result and it's likely to take many months. Joys!

Makes you wonder why you send the appeal to the tribunal people yet sss have it for so long before it's sent to the tribunal people, so clearly given the opportunity to read and check everything before they actually send it. Seems a bit unfair when it's meant to be a first tier team who have nothing to do with sss.

I sent a lot of evidence. Was 20p a sheet to print and cost me £8.80. So I sent a lot lol with a very detailed timeline of the last year. Arseholes the lot of them.

Received my letter this morning - I’ve been refused with way less points than i was granted in my initial application! Anyone else have experience of this?

Ex benefits adviser here. The problem is that when you ask for a reconsideration they don’t just look at the part you disagree with. The whole claim is looked at again by a different decision maker, who may not agree with the original decision - which is why you’ve ended up with less points. Did you get professional advice before asking for the reconsideration, because if you did, they should have pointed this out.
