Odd comment, but I wasn't expecting much in the way of logic.

The potentially illegal part was being in the same room without good reason.

What they ate or drank while in the same room is irrelevant.

I.e. birthday party (refreshment choice irrelevant), not necessary for work reasons = illegal.

Work meeting (refreshment choice irrelevant) = legal.
