TLDR version: Sandie Peggie vs Royal College of Nursing is currently being heard. The hearing started on Wednesday 23 September 2026 and is scheduled to end on Thursday 1 October 2026.

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims were of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claimed to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and after a prolonged process judgment was handed down on 8 December 2025. That judgment is being appealed and an appeal hearing is expected to take place in 2027.

Additional legal claims have been raised. Sandie Peggie is taking action against the Royal College of Nursing, against three senior managers who were witnesses in the employment tribunal - Dr Kate Searle, Dr Maggie Currer and Esther Davidson, against Carol Potter, the chief executive of NHS Fife, for victimisation, against NHS Fife for discrimination, and against its director of people and culture David Miller for harassment. In addition, Sandie Peggie is being investigated by the Nursing and Midwifery Council over fitness to practice.

to be fair i would not fancy putting up a thread trying to argue a genderists point of view. Apart from it being difficult to explain the inner feelz of being a woman (or a man), born in the wrong body, i know i would be defeated by sheer logic, and would have to trot out “ i am being piled upon, etc. you transphobes bla bla bla,

This isn't something that people trot out , it demonstrably happens every time. It's impossible to have a respectful , productive conversation based on logic on the topic as the majority of people contributing prefer to entertain themselves insulting, humiliating, demeaning the character of anyone who doesn't tow the gender critical party line, and they feel entirely entitled to do so without restraint. (As also demonstrated by comments above on this thread)

If the EAT orders the ET to be reheard unfortunately I don't think we will hear from Upton as he is in Australia. I doubt that he would want to go through another ET & he cannot be compelled to attend if abroad.

I think it unlikely they will order a rehearing but if they do the evidence such as the complaints lodged on the internal systems, cross examination of witnesses and DrUs witness statement can all be used.

I agree DrU is unlikely to appear as a witness. Although video conference could be used to overcome the fact DrU is abroad.

The problem with your argument is its central assumption: that gender reassignment can be reduced to beliefs about sexist stereotypes, such as which toys girls and boys should like. If that were true, I could see how you reached your conclusion. But gender incongruence cannot be explained that way, and the assumption is theoretically weak.

Regardless, I am aware this discussion is not the purpose of this thread. I was simply asking what OP meant by “claims to be trans”. I understood the discussion to be about the legal issues, and I wasn’t aware of any legal question about whether DU was lying or being fraudulent about his identity.

Don’t worry dear, there’s no problem with my ‘argument’ because I’m not actually arguing. I’m stating facts. You can ignore them or disagree with them but they’re still facts: your use of the term “gender incongruence” shows where your beliefs lie - stereotypes. Stereotypes of any trait is basically harmful as it’s categorising a particular group in a particular way. Racism is rooted in stereotypes, as is ableism and ageism. A belief in gender incongruence is plain old sexism repackaged.

There’s no requirement to be respectful to people who do not behave respectfully. If I’m talking about a bunch of people who’ve been intimidating and behaving criminally, I’ll call them a bunch of thugs.

That group of women actively conspired to cause harm to a nurse. My only concern with calling them a cabal of witches is that it’s a gendered insult which I broadly disapprove of 🤣

The term cabal alone should have sufficient negative connotations Pickled, should you wish to preserve witches’ blushes. It was originally coined to describe a group of influential courtiers around Charles II - Clifford, Arlington, Buckingham, Ashleigh and Lauderdale - who sought their own advantage.

On the case side I think the witnesses very clearly show how much the RCN was captured and how it saw GC as wrongthink. Naomi in full force was her usual brilliant self. The one thing I’m a little confused about is the emphasis on the request for RCN representation for the second case. Surely the argument is stronger on their lack of zealous representation for the first one? Did the RCN genuinely think they’d sent Sandie an email offering this but addressed it to her membership number instead of her email address? So that’s why they’re focusing on the second case?
