I work in a toxic environment I have reported bullying and discrimination (disability) and the main outcome is worded as below:
Falsely making claims of bullying and discrimination towards members of the team. PARTIALLY UPHELD.
Where would you go from here please advise needed thanks.

You need to ask the consequences of the complaint being upheld.

You could find a new job and move on.

You could quit and raise a case of constructive dismissal.

You could contact campaigning groups and get their advice.

You could check your hr rules and possibly appeal.

If in a union could ask them for support.

You should definitely ask if your original complaint was upheld.

@Niceseasidetown Thank you for replying. does partially upheld means they agree with some and they do not agree with some?

Yes part upheld (agreed) but part wasn't

GottaGirlcrush · 22/06/2023 19:57

Who falsely made claims of bullying/harassment?

ChocChipHandbag · 22/06/2023 20:01

This is the result of a grievance raised against you, by someone else, right? They are saying that they believe that you have made some false claims of bullying and harassment, but that some of your claims were true.

User19844666884 · 22/06/2023 20:03

So, you raised a grievance about bullying? And this was the outcome?

Because it reads more as it a disciplinary case has been raised against you for making false claims, and that the disciplinary has been partly upheld. I.E. they partly agree that your claims were false.

Who falsely made claims of bullying/harassment?

They used the words bullying and discrimination during investigation. Later they verbally gave me a feed back stating that I was bullied but not discriminated against. Above statement is from the written investigations outcome.

The wording of your original post is really unclear.

The outcome states: "Falsely making claims of bullying and discrimination towards members of the team. PARTIALLY UPHELD."

Who was falsely making claims? Did someone accuse you if making false claims or have you accused someone else of making false claims?

Sounds like it’s partially upheld because of this- they agree you were bullied but not discriminated against (as for discrimination you have to determine it related to a protected characteristic such as sex, race, etc)

Bambooflowers · 22/06/2023 20:21

The accusation op says someone was falsely making claims. You raised the grievance? If so who was falsely making the claims?

ChocChipHandbag · 22/06/2023 20:21

Something has got mixed up here.

can you add any more detail? The introduction should explain the scope of the report.

this is the outcome of a complaint against you, not by you.

did anyone say at any point that a complaint had been made against you?

Bambooflowers · 22/06/2023 20:22

Yes this looks like a grievance against uou. Not by you. It reads like someone has raised a grievance you were making false claims.

something is mixed up I think

So the findings, are that you've been bullied but you've not been discriminated against. Are youvdueca meeting with mgt or HR for them to tell you the next steps.

Do you want to stay at the company?
Do you want compensation?
What do you want from them moving forward?

I want compensation and to move on elsewhere it has been hell 16 months.

Compensation? How will cash make any difference?

Lottieloo123 · 22/06/2023 20:53

Beware you can’t bring a case at tribunal for unfair dismissal unless you have 2 years service. Under 2 years service, breach of equality act (I.e disability) needs to be proven.

I suspect that’s why discrimination not upheld, to stop any claim for constructive dismissal.

did they provide the reasoning for the decision?

are you appealing the decision? That should be done if you are thinking of bringing a claim

Gracewithoutend · 22/06/2023 20:56

Do you have an idea of how much compensation you want? Are you comfortable negotiating for it? Although, you might be looking at constructive dismissal so maybe consult your union or a solicitor. I'm not sure but maybe ACAS could help? Can you get legal advice on your house insurance policy?

HR or mgt should be arranging a meeting to address the issue and let you now what their next steps will be.

True. But bullying arises from discrimination there is a lot of evidence email, records and some staff are prepared to give statements/evidence but to be honest I was overwhelmed during investigation I did not tell them everything I only told half of the story they don’t know about emails and other evidence.

So you need to appeal the outcome of the grievance and provide the additional evidence.

Why would you withhold evidence? If you had access to it at the time of the investigation it should have been submitted

The way it's worded seems more like a claim against you, a claim that you falsely accused and that the claim has been partially upheld.
