“Kellie-Jay Keen has been charged under s.127 of the Communications Act 2003 over posts made between 23 and 25 June.

As ex-police, here's how it works:
• No victim needed
• No intent needed
• The offence is complete once the message is sent if a court finds it 'grossly offensive' (DPP v Collins [2006] UKHL 40)

That's a very low bar for a criminal charge over words.

But Chambers v DPP [2012] EWHC 2157 set a high bar for these cases, and Article 10 protects speech that offends, shocks or disturbs. A district judge decides on 4th December.

One to watch.”

Does anyone know which tweet the police are calling 'grossly offensive'? I wish I could be there to hear what she says in response to the criminal charge.

I wonder if she's going to be represented by the Free Speech Union, sounds like a case that would be right up their street.

Given the amount of outright racist stuff she posts I can't say I'm shocked. Literally just today she posted about how the Tesco Christmas carrier bags don't have enough white people on them FGS.

I don’t follow her closely. But “representation matters” is either true and fair or not. It’s not suddenly outright racist when the team you don’t like does it.

I found the following on Rebel News:
The first concerned a speech she gave at a rally in which she called for Islam to be removed from British classrooms and institutions. The second concerned a series of tweets — including one about "Muslim fatigue" listing gang rapes, terrorism, Sharia courts, female genital mutilation, and the "two-tier system," and another calling Islam "a vile woman-hating marrying child rape hazing death."

But if someone made similar allegations about Christianity, Judaism, Scientology, or the Westboro Baptist Chuch, would the police arrest them too?

People are allowed to hold offensive opinions.

AuroraBloom · Yesterday 17:15

Perhaps she can join forces with her mate Tommy Robinson for a good old grift.

Quite. The hypocrisy is remarkable,

I can’t find that post - do you have a link?

Was it for her claims that Asian men were murdering white girls and using them for kebab meat? Because none of this surprises me. It's the right wing grift moving on from transphobia to racism because the magic money tree is drying up.

Surely it's only hypocritical if that poster complains about not enough black people on Tesco bags. Maybe she does but I'd be surprised.

I can on my own behalf state that I think thar anyone counting the races on shopping bags and then whining about it on social media is a dick. I do not think they should be arrested for that whining but I assume that's not the tweet that's got her into trouble.

Are you saying you know enough about the grooming gangs to know this is NOT true? If so, why did you not report their activities when you saw what was going on?

Datun · Yesterday 17:30

She says it was for something that was 'grossly offensive'. She was reading it out from a piece of paper. Is that a quote I wonder?

It'll be very interesting to see people argue what grossly offensive remarks are actually illegal.

I can see this back firing on whoever reported her. But one way or another, it will be interesting

There's no evidence it is true.

That's not how things work though, is it? If someone makes a claim and yet has no evidence to even suggest that it's happening then it is not on everyone else sane to prove a negative. Though who knows on here, it does rather depends on the individual's beliefs and looks about whether they are deserving of being presumed innocent until proven guilty.

Yes, she has strong opinions. But she has every right to hold them and to express them, as long as she doesn’t call for violence or action against anyone.

As George Orwell said, “If liberty means anything at all, it means the right to tell people what they do not want to hear.“

The police, on the other hand, have no right to seek brownie points by silencing someone who says things that offend some people.

So like when TIM claim they are in danger in male spaces, even though there are no records of any attacks? Is that what you mean?

It doesn’t originate with her though, does it? It was an unconfirmed rumour.

Yes. Exactly like that.

dracn · Yesterday 17:48

I have never liked her and frankly wouldn’t be surprised to discover she actually didn’t give a fuck about men in women’s spaces and was just in it for the grift.

I remember hearing her say she could never have a job because she wouldn’t be able to be pleasant to her colleagues. Well that’s great but who do you expect will support you?

She’s been in it for a decade, and at first there were no “grift” opportunities, just a few women, like us on FWR. So no.

For the grift?

I can’t imagine that many “TERFs” (for want of a better word) are making much money out of this racket, surely?
