Thanks for the thread. I was agog to learn that a defence argument is that science based fact is just an opinion, and not WORIADS.

which pretty much invites the tribunal to test that via grainger.

not me thinks a good strategy.

i assume that Naomi is representing wonder who is defending.

Adam Doyle was CE of Sussex NHS at the time.

lcakethereforeIam · 07/10/2026 20:38

The respondent defends the latter claim by pleading that evidence-based medicine is just an opinion, not cogent or coherent and not relevant to a weighty or substantial aspect of human life and behaviour.

🤯

Bonkers.

ProfessorRedshoeblueshoe · 07/10/2026 21:04

WTF ?

WTF ?

There is not enough WTF in the entire world for this one.

I wonder if the headlines of "NHS declares in court that it doesn't believe in science" might spur the government into action.

I'd pay good money to see that headline in all the MSM!

I wonder what Andy's response would be?

Wait, what??

That is fucking glorious! Let all the sun shine down on those bat-shit crazy words for all the world to see.

That statement is the pinnacle of 'operation let them speak'.

Is there a sort of unspoken implication that if evidenced based medicine is just an opinion then all other opinions i.e. non-evidence based medicine are equally valid?

If this is the case then I wonder why practitioners waste so much time attending medical school when all they really need is a bag full of personal opinions to spread around

I wonder if the whole of the pharmaceutical industry is watching. Why bother with rigorous and very expensive studies and tests over many years when you can just say take this drug and you'll be cured.

lcakethereforeIam · Yesterday 01:03

They're conceding that gender affirming 'care' isn't evidenced based medicine. Just vibes, I suppose. I'd have perhaps expected that they'd argue it was supported by the evidence available 'at the time', but this...? Do they have an eye on the future? Not detransitioners sueing, although that might be a factor, but more confused kids to be shepherded to the drug cabinet and the operating table.

borntobequiet · Yesterday 08:24

Very pleased that I will be able to follow this for much of today/tomorrow.

HydrangeaFig · Yesterday 08:47

I am not laughing at this defence quite as much as other people are - at least to the extent that I will be interested to see how they elaborate on it with respect to the Grainger criteria. After all, before the concept of evidence based medicine was enshrined in the NHS, medicine still had a scientific basis - people had transplants and test-tube babies as well as lots of more routine treatments.

The other watchers will be the insurance companies and ethics committees. Nothing like a good bit of medical malpractice and public liability to focus the mind!

Igmum · Yesterday 09:03

Well, glad to see the NHS is making excellent use of my taxes 🙄. I seriously hope this gets one helluva lot of sunlight. ‘Gender affirming care’ isn’t evidence based and any doctor fiendishly resorting to evidence is driven out.

LesLavandes · Yesterday 09:07

Where can I watch this tribunal? I am a patient at WellBN Brighton

I, erm, what? I can't even!

FarriersGirl · Yesterday 09:43

Well this is going to be fascinating. I did a masters in a medical discipline about 20 odd years ago. Understanding research methods and the hierarchy of evidence was pretty much the core of it. Interpretation of the evidence must weigh adverse effects, treatment burden, and economic impact alongside positive impacts, clinical experience and many other factors. Its is not just an opinion.

DrSpartacularsMagnificentOctopus · Yesterday 09:54

WTF, so the ICB are confidently claiming that evidence based medicine is just an opinion? Glad I don't get my healthcare in Sussex.

BoreOfWhabylon · Yesterday 09:57

Thanks for the thread. This one should be interesting!

borntobequiet · Yesterday 09:59

It’s a shame Nick W doesn’t seem to be there. But he has an awful lot on his plate.

ApplebyArrows · Yesterday 10:07

How long before they start arguing legal decisions shouldn't be evidence-based either?
