TLDR version: Sandie Peggie vs Royal College of Nursing is currently being heard. The hearing started on Wednesday 23 September 2026 and is scheduled to end on Thursday 1 October 2026.

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims were of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claimed to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and after a prolonged process judgment was handed down on 8 December 2025. That judgment is being appealed and an appeal hearing is expected to take place in 2027.

Additional legal claims have been raised. Sandie Peggie is taking action against the Royal College of Nursing, against three senior managers who were witnesses in the employment tribunal - Dr Kate Searle, Dr Maggie Currer and Esther Davidson, against Carol Potter, the chief executive of NHS Fife, for victimisation, against NHS Fife for discrimination, and against its director of people and culture David Miller for harassment. In addition, Sandie Peggie is being investigated by the Nursing and Midwifery Council over fitness to practice.

...is harassing behaviour. The right thing for a man to do if he walks into a F CR is to back out and apologise. Not walk in close the door and stand his ground. That's harassment.
Doesn't matter if he's got a ponytail. Or might wear a skirt.

woman's CR, and closed the door, that is undoubtedly harassment related to sex. A man that refuses to leave and stands his ground; that fact that he is wearing his hair in a ponytail, earrings maybe makeup, is still a man. And it is only GI that makes SF think he is a woman.

Were he not blinded by GI he would see that. GI told people not to see that a man alone with a woman at night refusing to leave a F CR when challenged is menacing behaviour.

SP grew up knowing men are men and women are women and women deserve privacy and then suddenly behind her back the rules were changed and now she's a bigot for expressing those views. "SP learned the hard way what being GC meant"

SF did not immediately ID that SP was a victim of a serious injustice and that was his job and he had been comprehensively disabled from doing his job properly because GI had the org which employed him comprehensively in its grip

I did not say to witnesses "do you know what I mean by that" it was quite carefully explored with the witnesses as to what they understood about GI and SR.

But its not just having heard of it, it is the context of thinking themselves one and that being affirmed. I think NC was making the point that in a medical setting if a child said I identify as a eunuch and this was affirmed as a valid identity the next course of action would be surgical. The fact that no one would feel able to say: how did you hear about that and what makes you think you are one is shocking.

I was commenting on the last sentence of the two from the post I quoted:
“If an 11 year-old, their having heard of eunuchs is seriously alarming.”

That’s why my post began with
“While I would agree with you generally, eunuchs are mentioned in…”

I think there are 11 year olds who can have heard of eunuchs without there being anything sinister behind it.

Thinking of themselves as one is something different, and acting (or being encouraged to act) in any way that takes that further is something many or all of us here would indeed find shocking.

She made alternative arrangements because of SFs treatment of her - not that he was unsympathetic but that he failed to see that she had a claim and was the victim. It proves the point - she did not get reasonable help.

SF's motivation in dealing with SP can't be separated from culture. It's not 'you know what I mean by that' - cross examination very carefully explored what witnesses knew, what beliefs were, etc.

DH seems to be next inviting to conclude whether GI is WORIADS, I'm not asking ou that because no one has been discriminated against in this case because of a belief in GI. It doesn't arise here because all witnesses accepted that GI and GC are opposing beliefs. And it doesn't have to destroy the rights of GC people; but it tries to shut them down

DH said the only person who had a problem with JBM's explanation of the SC ruling was me, that may be true, but the witnesses aren't lawyers and its not for them to draw holes in that. the tribunal has the evidence and submissions

There is nothing to suggest and no evidence before you to suggest that the YouGov polling is not true. It can and should be trusted.

[When Darlington Nurse made public Dodsworth's letter - it was going to be] a big problem for her. You will make your own interpretation of the 'Fair Care' documents, what it conveyed to members. It doesn't take the mindset of a convenyancing lawyer to understand that RCN has taken a position.

DH observes that the engagement session, the only person who took exception was C's counsel. And that may be because I am a lawyer and the two witnesses have other skills. It's not for them to criticise legal analysis. And he criticises the YouGov poll, PM accepted that it is well respected and there is no reason to suspect and no evidence before you that the poll was not fairly done.

And presence of a trans person says nothing to GI, it's not the presence of a trans person that C takes exception to, it's the fact that RCN seemed unconcerned and not willing to pursue the member is question. A union member can be expelled for cause, in PMs evidence there is nothing that FW could do that would result in RCN expelling them - evidence of the grip of trans ideology on RCN.
