TLDR version: Sandie Peggie vs Royal College of Nursing is currently being heard. The hearing started on Wednesday 23 September 2026 and is scheduled to end on Thursday 1 October 2026.

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims were of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claimed to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and after a prolonged process judgment was handed down on 8 December 2025. That judgment is being appealed and an appeal hearing is expected to take place in 2027.

Additional legal claims have been raised. Sandie Peggie is taking action against the Royal College of Nursing, against three senior managers who were witnesses in the employment tribunal - Dr Kate Searle, Dr Maggie Currer and Esther Davidson, against Carol Potter, the chief executive of NHS Fife, for victimisation, against NHS Fife for discrimination, and against its director of people and culture David Miller for harassment. In addition, Sandie Peggie is being investigated by the Nursing and Midwifery Council over fitness to practice.

Miss Tate up next.

Who dis?
Sorry, where are my manners - who dis, please?Smile

ickky · 29/09/2026 11:44

That is the sum total of my knowledge of the next witnesses. I have no clue who they are or what position they hold within the RCN.

SlackJawedDisbeliefXY · 29/09/2026 11:44

Out of interest, does anyone know how many of the RCN's reps are female?

BettyBooper · 29/09/2026 11:44

DH you were taken to your notes of a phone call with SP. What care and attention as you were typing whilst speaking.
SF not the best but as the person is speaking I’ll try and type.
J thank you Mr Fraser. Let’s take a break. When we come back we’ll start with Ms Tait’s evidence.
DH the respondent will call Ms Tait for 1.5 hours and Ms Marquis. Respondent Ms Jalal will not be called.
NC we will finish this afternoon. Ms Marquis I estimate 3 hours
J let’s break for 10 minutes. Back at 1153.

nauticant · 29/09/2026 11:44

Gillian Tate (also referred to as Gillian Tait) is a senior officer and representative for the Royal College of Nursing (RCN).

Could the other be:

Patricia Marquis is the Executive Director for England at the Royal College of Nursing (RCN), the United Kingdom's largest professional nursing union and trade body.

All of this just makes you realised how bad unions are at fighting for workplace rights and how easy it is for them to back out of supporting you at all.

They seem incredibly similar to insurance companies, deny as a default position any claim.

OhBuggerandArse · 29/09/2026 11:45

Gillian Tait mentioned in this Day 1 report from Nick Wallis - legal rep of some sort. https://genderblog.net/peggie-v-rcn-title-here/

So it's totally fine that I changed the words SP used and instead changed them for ideological terms. Is that what this is an attempt at?

YouCanCallMeMonster · 29/09/2026 11:47

Stuart is typical of the men we have seen in these tribunals in the last year. They are not true believers in fact I suspect they are a bit mystified by it all but they go with the flow and accept the position that TW are vulnerable and must be protected and that TWAW because that’s what they were told in the EDI training that they had to attend. Everyone else is putting pronouns in their signature blocks so they go along with that also so they don’t stand out from the crowd. They accept what they are told by people in authority and by people who they think are better educated than they are…..so when someone like NC attempts to make them reflect on what they actually believe and use some logic they cannot cope.

Suddenly the 'contemporaneous notes' are less accurate for being contemporaneous?

Seems like a leading question from DH - would a judge pay attention to these sorts of attempts to muddy the waters?

I've just made flapjacks. I hope they are not tainted by m rage listening to that load of obfuscating bollocks.

FedUpCelery · 29/09/2026 11:15

Yes, preferable to a nurses union to admit doctors are prioritised over nurses than TIMs are prioritised over women. It's mind boggling

I hope nurses are paying attention and are leaving in droves for the DNU

Yes, I don't think that generally doctors are prioritised over nurses - particularly not junior doctors.

Junior doctors famously have to move every six months for their training, and so often don't feel part of an established team. And in the current climate are always at risk of being unemployed.

I think it's much more likely to be the case that some VERY SPECIAL MEN are prioritised over women.

Typing “she” and “female” whilst claiming not to be paying attention to what you were typing because you were focussed on listening doesn’t support your case, Stuart! In fact it strengthens NC’s argument about your bias as you automatically write “she” and “female” when Sandie is describing her encounter with a TiM in the female CR.

Mmmnotsure · 29/09/2026 10:58

Presumably because he'd like to keep his well-paid job while continuing to be lazy and incompetent.

I am still shocked that his background is customer service and not nursing (or any profession represened by RCN). The paygrade makes sense for someone, eg a workplace rep, to make a sideways move from a senior/long-serving nursing role into a full time regional union officer. But a customer service bloke who has never needed to use a hospital staff changing room, or known what it is to earn a nursing pin and need to follow rules and regs to keep hold of it? That's bonkers.

anyolddinosaur · 29/09/2026 11:52

@StellaAndCrow First year junior doctors may be treated badly by their employers but in a nurse/doctor dispute the nurse would still expect the doctor to be favoured. It's the class thing again.

CriticalCondition · 29/09/2026 11:52

Gillian Tait took over from SF as SP's rep in June 2025. DH claimed she was active on SP's behalf and keeping her in the loop. SP said not.

Gosh I hope not, there's absolutely nothing worse than an obfuscating-bollocks-induced-rage-tainted flapjack😝

What, the notes that were done "a few days after"?

From yesterday's first afternoon session:

DH notes say 8th January 2024 - when did you call?
SF in my diary called 5th didn’t get her then called her Monday 8th
DH notes made?
SF a few days after

Boiledbeetle · 29/09/2026 11:54

Bugger, my viewing is now interrupted by a need to go attend an appt.

Past experience suggests that this is what passes as contemporaneous.

I'm sorry, I just can't this morning.

I could do a trial 10 minutes if that's any help?

Could anyone else offer?

anyolddinosaur · 29/09/2026 11:55

Of course female doctors are still treated worse than male doctors too - the conspirators knew very well what sex Upton was. A female doctor who had gone to their line manager in tears at a senior nurse having a few words with her would have been told to go home, sleep on it and consider if she was actually suitable for the demanding A&E environment.

SomewhatGlad · 29/09/2026 11:56

TT

Next witness is expected to be Gillian Tait, Senior Officer RCN.

Sworn in.
