TLDR version: Sandie Peggie vs Royal College of Nursing is currently being heard. The hearing started on Wednesday 23 September 2026 and is scheduled to end on Thursday 1 October 2026.

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims were of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claimed to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and after a prolonged process judgment was handed down on 8 December 2025. That judgment is being appealed and an appeal hearing is expected to take place in 2027.

Additional legal claims have been raised. Sandie Peggie is taking action against the Royal College of Nursing, against three senior managers who were witnesses in the employment tribunal - Dr Kate Searle, Dr Maggie Currer and Esther Davidson, against Carol Potter, the chief executive of NHS Fife, for victimisation, against NHS Fife for discrimination, and against its director of people and culture David Miller for harassment. In addition, Sandie Peggie is being investigated by the Nursing and Midwifery Council over fitness to practice.

Once for Scotland sounds like some sort of death notification process that saves multiple phone calls and lots of copies of the death certificate.

DH done

I'm kind of imagining it being shouted by this guy. Nearly the trans colours, too.

From Nick Wallis as clearer than TT at this point

NC and to und EDI you need a workign understanding of discrim law
PM yes not an expert
NC no not a lawyer but need to keep an eye on it
PM yes
NC to keep an eye on EDI you need to keep an eye on how diverse you are as an org
PM yes
NC and you do that by collecting data

Boiledbeetle · 30/09/2026 10:55

nebulousMoose · 30/09/2026 10:53

Go for it Boily 😍🧁📝

I shall ponder on the subject.

If there isn't there should be...

Is editing recipes easier or harder than poems?

"The baked in rights" a cookbook by the MN Vipers.

It would make a lovely companion to the collection of poetry! 😃

Yes but do not exclude the vegetables, that would be terrible and not inclusive.

From TT:

monitoring of your org?
PM Certainly one of the way, yes.
NC to RCN response to C. C asked RCN how many members f, m, PC of GR and how many GC beliefs. Answers were RCN has approx figures 86/12% for members but can't confirm if bio m/f as R didn't capture that info

NC RCN hasn't been collecting bio sex data for some time
PM Yes
NC So mainly f as v few men in that f category
PM Yes
NC But if want to analyse - who is allowed to speak at congress/ jobs etc - need to know re seniority, pay, the answer may be badly skewed by small no of TiMs

Appalonia · 30/09/2026 10:58

Ha NC has bamboozled herself!😂

StSpiridian · 30/09/2026 11:00

I used to assess board governance for my job- didn't knit (!!) but did use a graph,. It's really helpful to see who is dominating the board and who is silent (or asleep as happened once)...

ickky · 30/09/2026 11:00

😱That could be a dangerous list.

fanOfBen · 30/09/2026 11:00

From TT:

PM Please repeat
NC Proportions roughly right. Majority f members. Council meetings - do you know trick of ppl knitting during meeting change colours when man or woman speaking. If you did that in council meeting with say 16 members, say 12 w and 4 m, and someone doing

knitting trick, if one person is m id as w, you will skew the knitting result. It will be a meaningful difference even if change to baseline figures not meaningful.
PM Lost me
NC Over 600.000 TiMs won't skew the figures v much. But they will eg in a council meeting with few ppl

MarieDeGournay · 30/09/2026 10:39

I'm repeating myself from yesterday but - wouldn't it be good if all unions' first action when faced with a difficult case was to say
'Right folks- what does the law/workplace regulations/ etc have to say about it, and we'll take it from there'

You'd think it would be the starting point yes.
I feel confident it's where a lot on here started out.
"You say the law is what now?....no, i've had a read and it isn't"

I had a colleague fall asleep in a meeting once. It was a dial up one and she was attending in a room with her boss beside her. She fell asleep and her boss, very kindly moved the camera so she could not be seen. It escalated when she started snoring... Not sure what colour a snore would be.

Boiledbeetle · 30/09/2026 10:55

I shall ponder on the subject.

Can we just check something, Boily, you're not one of these are you?

Biscuit beetle (Stegobium paniceum). Also known as drug-store beetle. Damage caused by larvae. Causes damage to paper, books and starch-rich board.
Causes particularly bad damage to cook books with recipes for flapjacks in, nyom yom yom yom😁

RoseInAPot · 30/09/2026 10:40

True, but we should expect better from the Times; the journalist didn't use the abbreviation, he wrote it all out. Someone should have spotted it and corrected it but they clearly don't understand the context.

Perhaps the journalist and editor should read the comments on their articles?

You say the journalist didn't use the abbreviation. We don't know that unless the Times tell us. We know what the published article looks like, but we don't know what it looked like when the sub-editor got hold of it. It is possible the journalist wrote "EHRC" and the sub-editor decided it needed spelling out in full and wrongly expanded it to European Convention on Human Rights. But yes, it is also possible that the journalist didn't use the abbreviation or used the wrong abbreviation.

inc a TiM
PM Yes
NC So could skew the monitoring figures quite badly in some instances
PM Yes
NC You have no number re members of PC GR / hold GC belief.
PM Didn't collect until recently
NC Now
PM We have updated all of our monitoring from July. Not specifically GC belief

but of characteristics.
NC Learning from these proceedings
PM No, we realised from our EDI strategy needed to improve
NC You told DH your membership is reflective of society. Would reflect society well cos so big
PM No, depends what kind of society you are. But cos of our

fanOfBen · 30/09/2026 11:06

membership would expect to reflect society over many issues.
NC [to doc] YouGov report on polling social attitudes to t rights. Methods sound and rigorous
PM No expert but would trust.
NC Reads - scepticism has increased. Whether ppl think can id as something not recorded

at birth. Quite extraordinary. Many GC would say you can id how you like - train or anything. But we see %s of all Britons who think ppl shouldn't be able to id as different gender rose to c 40%. And similar rise c ppl being allowed to change legal gender.

Boiledbeetle · 30/09/2026 11:09

NC being way to wordy for my brain this morning.

fanOfBen · 30/09/2026 11:10

From TT:

NC Ppl were asked if TW - ie not bio f, but men who say they're women - figures for all Britons saying TIM shouldn't be allowed use f cr - rose from 30 % in 2018 to c 60% in 2024
P:M Yes
NC So 60% public thought TIMs shouldn't be using w c rooms.
PM According to survey, yes

NC To breakdown in detail. Summary. British attitudes to t rights. Pink/green/dark green show split in categories between ppl who agree/disagree. Under access, statement TW should be allowed use w cr. All Britons - majority disagree. Younger class

I feel confident it's where a lot on here started out.
"You say the law is what now?....no, i've had a read and it isn't"

It's mind blowing. I had a job implementing some workplace legislation across a number of NHS trusts. At every event we held, we brought in a lawyer with relevant expertise to speak. As an NHS employee with responsibility for advising NHS organisations, i also had to have a thorough understanding of that legislation. If ever I was unsure, I got a legal opinion. Every time.

I don't understand why unions aren't held to the same standards. The BMA was just as hopeless as the NMC . And oh my god, their bundles!

fanOfBen · 30/09/2026 11:13

also. Even Lib Dems don't agree.
PM Yes
NC Statement TIMs not allowed to use w cr. Fundamental part of gc belief or dissent from G
PM Yes
NC Can be characterised as broadly GC
PM Would say that. but see why you saying that.
NC Isn't it part of it.
PM Don't think the two parts are opposites.

NC You don't have views of your membership but safe bet that good proportion of general public don;t think tims should use w cr
PM Will be broad view across our membership, for and against
NC But your members aren't outliers.
PM Yes, good reason to believe they will agree

Subeditors are journalists too. It’s sloppy journalism in the Times regardless of who made the error.

Naomi, take a break!!!

YouCanCallMeMonster · 30/09/2026 11:15

NebulousSupportPostcard · 30/09/2026 10:23

It is slow enough to be captured comprehensively in the summaries, I would take a chance on logging in and out/ trying other devices to be ready for Naomi!

I’m in now but tragically I will miss most of NC, cross as I have commitments I cannot get out of today.

Seriestwo · 30/09/2026 11:16

“Even Lib Dem’s don’t agree”
pretty damming, then.

Boiledbeetle · 30/09/2026 11:16

Yay!
