TLDR version: Sandie Peggie vs Royal College of Nursing is currently being heard. The hearing started on Wednesday 23 September 2026 and is scheduled to end on Thursday 1 October 2026.

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims were of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claimed to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and after a prolonged process judgment was handed down on 8 December 2025. That judgment is being appealed and an appeal hearing is expected to take place in 2027.

Additional legal claims have been raised. Sandie Peggie is taking action against the Royal College of Nursing, against three senior managers who were witnesses in the employment tribunal - Dr Kate Searle, Dr Maggie Currer and Esther Davidson, against Carol Potter, the chief executive of NHS Fife, for victimisation, against NHS Fife for discrimination, and against its director of people and culture David Miller for harassment. In addition, Sandie Peggie is being investigated by the Nursing and Midwifery Council over fitness to practice.

I think my two takeaways from today are

  • omg these people are supposed to advise members on their rights, and they have no clue, and no shame about having no clue, what those rights are
  • honestly quite a lot of NC's questionning today was just annoying to watch and I'm sure even more annoying to experience. I'm guessing that a lot of it is that she needs to introduce into evidence a lot of stuff about how captured RCN is, e.g. the merch and Freda W's training and the flag, but she can only do that if she asks a witness about it. So she asks the RCN witnesses about this stuff, even though, they rightly feel, it often isn't really much to do with them.

With my fan of Ben hat on, I do feel one of the things he does better(? more clearly from a listener's perspective) is syntax. Naomi often seems to tie her sentences in knots and confuse the witnesses about what she's asking, quite separately from whether they want to answer. I need to pay attention next time I hear Ben, but memory is saying that the key difference is that Naomi's characteristic question goes "question, long content about which this is a question, ?" whereas Ben's goes "Long content, question ?". E.g. Naomi might go

Anyone else think so? If so, is there a reason? Is she just trying to be crystal clear that there is a question, not just a statement? Is she deliberately trying to wrong-foot the witnesses?

Yes I've often thought that her questions are frequently long winded and just confuse the witness.

This afternoon's victim witness used the expression 'partnership workings'. I've never heard that term before but it sends shivers down my spine for some reason.

Also, she seems to have been banging on about how 'useful' a phone conversation would have been: useful for whom, I wonder?

I'm unclear about Fred Wallace (who isn't?) but is he training to be a nurse? Do we know this for sure? He was a patient transport driver and I believe he was 'let go' because he proved utterly unsuited to contact with other human beings, so please God they aren't allowing him to become a nurse.

I might be misremembering but something sticks in my mind about him studying for a degree. Also didn’t he threaten to access the medical records of the non verbal disabled woman who he abused on X? Didn’t he threaten that he could ‘flag’ her record? Or again am I being unfair to him?

I don’t quite agree. NC is not just asking questions she is putting ideas before the panel that she know the witness will wriggle out of but actually give important hinterland.

It’s not just about the witness and their credibility but what their approach and understanding demonstrates about the RCN in general. She has to produce layers. Ben didn't have to do that because it was more about the witness providing evidence about more surface information,

For example, GTs continuing attempts to avoid demonstrating any knowledge that might bring harm down on her ie anything that might be seen by activists and misogynists back at base as being anything other than trans positive - tho she is skating on thin ice agreeing with the law - shows that what matters more to her than repoing members is her own standing. This matters be because union reps should not feel afraid of a) asking questions b) doing research c) understanding recent ET and EAT decisions.

The fact that a rep thinks it acceptable to have no responsibility of informing themselves about the wider contexts of a member’s suspension is indicative of capture. The fact that she claims the entire responsibility for informing her lay on SP setting it out clearly during a phone call or two is an entire abdication of responsibility yet GT thinks it covers her back.

I think she is usually very clear. But the swishing white noise of terror between their ears causes the witnesses some problems. I think they are often just taken aback by what she is asking them that they play for time by asking her to repeat her question.

Lol, I suspect her tactic was to simply try and point score on every question asked of her. I couldn't quite believe my ears when she said she didn't think members would have any qualms about approaching the RCN to complain about a black person using the changing room simply so she could reject the claim that women like SP might not risk coming forward through fear of how they would be treated. I think even NC was momentarily stunned into silence

I think he told a severely disabled woman that he could flag her records & she'd never get an ambulance sent out to her.

I was struck by that as well. I had to address the judge once in the High Court during a JR. And had to refer to a barrister that I know well and would be happy to refer to by her given name in a social situation. I called her Miss ...

This is like Schrödinger's Union. They would have represented SP beautifully had they been able to talk to her so they could understand her position, until they understood her position which was unacceptable.

I'm fast forming the opinion that unions are just money making rackets. You must be part of a union for your own protection. However, once you need protection, there is <insert reason> why you can't have the protection you need. Of course, if you aren't part of the union, they say 'If only you were part of the union, we would have protected you!'

DH had a serious employment matter re. redundancy. He contacted his union, who batted him backwards and forwards, told him to 'keep them updated' and asked 'what he wanted', then when he sent them a letter I had drafted for him because we'd reached an action deadline and they'd not helped at all, they just said "That's a great letter! Let us know how it goes..."
