Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence was 29 July 2025. It resumed again over 1 to 2 September for closing submissions.

Following handing down of the judgment on 8 December 2025, on 11 December 2025, it was announced by Sandie Peggie and her legal team that they would be pursuing an appeal.

It all occurred when Dr U was an employee of Fife NHS. If they hold another "hearing" of some kind they will be covering the same events when he was an employee. I was thinking that the clock had stopped at the date of the ET.
If they re-examine the events of those dates NHS and Upsie are still entwined and re-living those dates.
Most of you are assuming that Upsie is now separated and my assumption is wrong. Anyone have the time to explain it to me please or tell me where it was covered?

Yes, it is possible for the EAT to say that the tribunal got the law wrong, set out what the law should be then send it back to be reheard by a different ET.

Indeed, common. V hard for any appeal court to determine what the facts ought to have been or the findings that ought to have been made, had the original court or tribunal directed itself properly.

I never got the vibe from Dr U that he wanted/would pivot to a career in trans practice. His absolutism on his biological woman-ness seemed to me to need to be rooted in 'general' practice (as opposed to GP specific definition). I think being in trans practice would be too much for him - the cognitive dissonance of knowing the person across from him was doing the same non-robot dance (and they both knew it)would break him

Yes, if the case is sent back to be reheard it will be about the same events. However, Upton is no longer employed by NHS Fife and may have left the country. That raises questions as to whether he will want to continue to defend the case and whether he will appear as a witness again. He cannot be compelled to give evidence if he is now living in Australia.

Right from when the judgment was handed down it seemed to me that with such a partial interpretation of the evidence, basing an appeal on such a corrupted evidence base would be something to be avoided. It would need to be reheard, assuming such an outcome could be engineered, and that Sandie Peggie would have agreed to the pain of going through it all again.

With these recent events, and taking into account the mess that ETs have been making to sabotage the implementation of the Supreme Court judgment, then a rehearing, should such a thing be possible, is the thing to aim for. But this depends on what Sandie Peggie wants.

Lots of early career docs do head to Aus or NZ for a year or two. He does still have his license to practice here so could easily return. Whilst checking out I notice that Dr A Harrop no longer has a licence to practice. Perhaps he is rejuvenating his media career instead. He was associated with the Welsh gender service at one time

The familiar name of a Dr Upton has appeared on the Australian Medical Register this week at a hospital in Port Macquarie, NSW. I’m guessing the rumours of Upton moving to a new country are confirmed. Listed as ‘female’ but no mentioned of nebulous or ‘not a robot’
