Five nurses working at Darlington Memorial Hospital have filed a legal case suing their employer, an NHS trust, for sexual harassment and sex discrimination. The nurses object to sharing the women’s changing facilities with a male colleague, Rose, who identifies as female. The hearing started on October 20th, with evidence starting on October 22nd and is scheduled to last 3 weeks. To view the hearing online requests for access had to be made by October 17th. The hearing is being live tweeted by Tribunal Tweets who have background to this case on their substack. An alternative to X is to use Nitter: nitter.net/tribunaltweets or nitter.poast.org/tribunaltweets

The Judge made clear at the start of the public hearing on Day 1 that only TT or press have permission to tweet. If online observers see/hear something in the court that isn’t reported by TT, we don’t mention it until the next time there’s a break. This is a very cautious approach to avoid any accusations of “live reporting” on MN. Commentary on the content of TT tweets is fine as soon as they’re posted on X.

So they are going to face disciplinary when this case has resolved.

I really feel for the nurses, it must be exhausting.

The names of those seven people are not given in the Trust's (open) minutes, so speculation on my part, but (and I hope I am wrong) given what this witness has said about confidentiality, I suspect they will be disciplined for giving interviews to newspapers.

Any idea why the judge was rushing NF? I thought he'd said he wanted 4 hours for this witness (and I don't recall anybody else being lined up for today).

I can't get my head around the fact that there are some highly paid staff sat together watching the entire tribunal (their combined salaries must hover around £1/4M at least).

I think counsel must be having an argument about something. Either that or they are looking at a copy of Racing Post and placing their bets for this afternoon's racing.

I don't think that's the case here, so I wonder if there's something going on behind the scenes?

I was thinking that he doesn't want the claimants barrister, who for some reason I think of as Shere Khan from the jungle book, to ask certain questions because he wants to keep what he calls 'on track.'

The argument before the break was that NF shouldn't be able to talk about non-complainants but now, seemingly after some kind of stramash, he does seem to be pursuing this line of questioning.

I did a 'thought experiment' I read somewhere with a young man I knew who was oblivious to the way women have to read the risk in some situations.

I asked him to imagine a third sex that was bigger, stronger, taller, faster and more aggressive than men. And of whom the vast majority were sexually interested in men.

And asked him to imagine how he would feel living his life where half the people in his world could, if they wanted to, physically overpower him with ease. Probably with one hand. And force him to have sex.

He didn't really want to think about it but I hope I planted a seed.

He's probably still having nightmares about it.

It seems they were desperate to whittle down the number of complainants.

I really can't see the reason why, 1 is enough. Did they think they could get all of them to withdraw?

Yes, the documents are locked in the room that is only accessible during the public sessions of the Tribunal.

I was trying to lurk in the room to read the bundle during a previous Tribunal and Simon Cheetham got me booted out.
