"Darlington Nurses" vs County Durham and Darlington NHS Trust Tribunal Thread 2

1000 replies

ThreeWordHarpy · 23/10/2025 14:17

Link to Thread 1, 7-Oct to 23-Oct; pre-hearing discussion, evidence from KD (Day 1) and BH (Day 2).

Five nurses working at Darlington Memorial Hospital have filed a legal case suing their employer, an NHS trust, for sexual harassment and sex discrimination. The nurses object to sharing the women’s changing facilities with a male colleague, Rose, who identifies as female. The NHS trust’s HR department dismissed the nurses’ concerns, stating they should “broaden their mindset” and “be educated”. More details can be found at Sex Matters and at Christian Concern who are supporting the nurses via the CLC.

The hearing started on October 20th, with evidence starting on October 22nd and is scheduled to last 3 weeks. To view the hearing online, requests for access had to be made by October 17th. The hearing is being live tweeted by Tribunal Tweets who have background to this case on their substack. An alternative to X is to use Nitter: nitter.net/tribunaltweets or nitter.poast.org/tribunaltweets

The Judge made clear at the start of the public hearing on Day 1 that only TT or press have permission to tweet. If online observers see/hear something in the court that isn’t reported by TT, we don’t mention it until the next time there’s a break. This is a very cautious approach to avoid any accusations of “live reporting” on MN. Commentary on the content of TT tweets is fine as soon as they’re posted on X.

Important scheduling information, SC said it looks like the claimants' witnesses will be done on Tuesday or Wednesday with the Respondent's witnesses starting on Wednesday.

That's when it might really get lively.

Don't know if it's already been mentioned here, but the Sun newspaper is running a poll today on "whether trans staff should be allowed in female locker rooms"

53% have voted men in women’s changing rooms is not an issue. 🤣🤣
Looks like the trans mob have had a pile on to that poll

( The Sun poll of the day )

ickky · 23/10/2025 15:55

My god, they could have done 10 minutes with the next witness already.

IDareSay · 23/10/2025 15:56

TT

SC now explaining that each witness involves some elements of repetition. And discussing with the Judge the length of time for the next witness, expected to be Jane Peveller.

IDareSay · 23/10/2025 15:57

TT

SC - I will be an hour with JP, I cannot see that I will be more than an hour or an hour and half with any of the other Cs, so, if JP gives evidence tomorrow we can get through her and 3 other witnesses.
J - an earlier start tomorrow may be a better answer.

IDareSay · 23/10/2025 15:58

TT

NF - it may be an issue on my side, Cs are struggling to arrive with the traffic.
J - any benefit in starting with JP
NF - if we are not constrained tomorrow we may put another witness in first.
J are they in the room can we check?

CVP has been abruptly closed.

Sorry for thread jumping response @maltravers Trust did (eventually) set up another women's changing room. Though it was inadequate for various reasons.

Thank you

ILikeDungs · 23/10/2025 16:00

9:30 start tomorrow?

Signalbox · 23/10/2025 16:00

Sorry if this has already been discussed but has anyone had any joy joining with Pexip?

ChimpanzeeThatMonkeyNews · 23/10/2025 16:01

If those witnesses can beat the traffic?

IDareSay · 23/10/2025 16:01

TT

J - we will finish today and start again tomorrow. Need a discussion about case management and once legal reps back in, there are many, you can decide how many want to come back in.

think court is risen, only have sight of witness box

Sorry @IDareSay I duplicated

Sorry @ickky just seen this! Duplication better than nobody picking up 😁

I knew I would be at my laptop for an hour so just dived in. Hoping @MyrtleLion will be home soon and keen to get back to work for us tomorrow Flowers

YouCantProveIt · 23/10/2025 16:05

I have. Yesterday was fine, but several times today I had sound but not video in the courtroom.
I just kept leaving and rejoining until it worked. The clerk was pretty quick at letting me back in.
It had to be the only screen open on my iPad. No moving between the tribunal and MN.

Binglebong · 23/10/2025 16:10

Does anywhere do a summary of the day? I know TT do a thread unroll but I miss nuance! I'm not able to keep up with this one as I did Fife but would like to be informed.

YouCantProveIt · 23/10/2025 16:11

End of day 2. Good that the case is live and running. Good that they had strength in numbers. Sandie was really out on a limb at Fife wasn't she.

Well organised and they clearly see Mrs Hutchinson as a ringleader. NHS barrister said that would be his longest witness on claimant side. Everyone else should take less than 2 hours.

Have said that they are on time for the schedule.

Felt Mrs H was a good witness, knew her stuff.

Darlington seem more with it - so less Isla Bumba I don't know if I am a woman nonsense to come - but you never know!

Londonmummy66 · 23/10/2025 16:18

and no A&E consultants to say that it is all so complicated..................

YourWiseBee · 23/10/2025 16:19

Just came on to MN but being following in TT - this is no Naomi - although it is early in the case. I think the nurses need to win - in that they absolutely have the right to SSS and Rose should never have been given access but I think witness today definitely lost the judge. Although I am not sure what resolution there could have been apart from removing ‘Rose’ from the changing room.

AMillionMugsNoTeabags · 23/10/2025 16:22

Just boggled by the Sun poll results. More than 50% say no issue with men in changing rooms.

ickky · 23/10/2025 16:23

Is it finished now? I though it was a break and they were coming back.

It’s the Sun. Page 3 featured topless young women until I think 2015.

A changing room will be full of such totty in certain imaginations.
