NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #51

nauticant · 01/09/2025 13:38

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence was 29 July 2025. It resumed again over 1 to 2 September for closing submissions.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February 2025. Sandie Peggie returned to give more evidence on 29 July 2025.

Access to view the second part of the hearing remotely was obtainable by sending an email request to [email protected] by 5pm on Wednesday 9 July. Detailed instructions were provided here:

Is JRs mic off?

MyrtleLion · 02/09/2025 10:08

From TT

J - right

NC - sorry to jump in when floor is JR's, but I've seen an application from Rs to amend grounds of pleading, it needs to be dealt with in JR's hour of time remaining for submissions.

J - what does JR want to do with it

JR - I want to complete my closing and then

GCITC · 02/09/2025 10:08

Big Sond already sounds like he wants to go home

Boiledbeetle · 02/09/2025 10:09

What are they arguing about?

ickky · 02/09/2025 10:09

What new fuckery are they discussing now?

chilling19 · 02/09/2025 10:09

Sound is terrible

Boiledbeetle · 02/09/2025 10:09

I see we are at the top of a windy hill again.

GCITC · 02/09/2025 10:09

Oh Jesus, I was only joking about the case being adjourned, please don't make it come true!

nauticant · 02/09/2025 10:10

Amend pleadings on final day of submissions at the end of 7 months?!

OP posts:
MyrtleLion · 02/09/2025 10:10

From TT

address it. But it will take an hour to complete my closing. And then do it.

J - that is contrary to what NC asked.

JR - yes,

J - how long will you be

JR - an hour to complete, plus 10 to 15 minutes to discuss amendment

J - it's an even if, we do need to amend....

JR - yes

J - NC how long will you need

NC - 15-20 minutes

J - do we have to do this today, can we do by written subs

NC - I would ask you to do it today

J - could we do it by written

NC - that would increase the prejudice to the Cs, because we would insist on add'l evidence

NotNatacha · 02/09/2025 10:10

My sound is terrible, too.

I'm in room 4. Is it bad for anyone in a different room?

chilling19 · 02/09/2025 10:10

do we know what the amendment is?

What are observers doing to to desensitize themselves ready for the end of JR's submission?

Prepping with energy drinks and caffeine?
Listening to a looped recoding of foxes mating?
Fingernails scratching down a blackboard?
Applying tape to prevent eyes closing?

I've got a plug and Lego inside my crocs

Yes, I like this @betterBeElwinNextIGuess I had never heard of a male Beth until I heard of Dr Beth Upton. It makes me think of Dr Hilary, remember him? I had never heard of a male Hilary until I heard of Dr Hilary Jones. So now Beth can also be a male name, lovely, just like Hilary. The beauty is, you can do that with any name. To massively mis-quote another much loved transwoman in his youth, 'It's not a girl's name, it's mine'.

I have a young relative called Beth and I suspect she would quite appreciate it becoming a unisex name, having gone through a phase in her teens of calling herself "Zab" to create exactly that sense of ambiguity (it didn't stick, I don't think she was even convinced herself). But somehow I don't think Dr Upton's fifteen seconds of fame will have parents rushing to call their newborn sons Beth.

GCITC · 02/09/2025 10:11

And if it is amended, NC saying witnesses will need to be recalled.

Room 5 - sound is awful

MyrtleLion · 02/09/2025 10:12

From TT

leading to more hearing days, which could not be listed for some time, I strongly suggest that you deal with today.

J - we will hear subs to completion, we will then have a break, we will then hear the application and opposition, and it may be that I need to deal with them on

CohensDiamondTeeth · 02/09/2025 10:12

CriticalCondition · 02/09/2025 10:05

Blimey. I know one shouldn't comment on women's clothes but JR is dressed completely in white. Normal court attire for barristers is something dark and sober and she looks like she's going to be scrubbed from someone's wedding photo.

I'm that annoying person who tells people off for making unnecessary comments on what people are wearing or how they look - no one can help how they're made, and fashion is subjective. I find that kind of thing really mean spirited.

But I don't wear white at all, a lovely white two piece suit would stay white on me for a grand total of 0.01 seconds.

I am clumsy AF and I drink a lot of coffee, it just would be an accident waiting to happen 😅

NotMyRealAccount · 02/09/2025 10:12

(Double post bug, my apologies.)

MyrtleLion · 02/09/2025 10:12

From TT

the papers, we need to hear both these things and then see what we are able to decide. We will complete the submissions and the application first.

NC - I suggest that you litigate the prejudice to the C by limiting JR's time for subs to 45 minutes,

J - why

NC - the hearing has

How do people know what room they are in? I've never known. I can't see anything that tells me.

That beautiful white suit isn't shown at its best when its wearer is sitting down. Horizontal creasing, and a bit of pulling at the buttons.

Miaou...
