https://www.theguardian.com/society/2025/aug/18/transgender-judge-supreme-court-case-biological-sex

'The UK’s first transgender judge has launched a case against the UK in the European court of human rights challenging the process that led to the supreme court’s ruling on biological sex.
The retired judge Victoria McCloud, who is now a litigation strategist at W-Legal, is seeking a rehearing of the case, arguing that the supreme court undermined her article 6 rights to a fair trial when it refused to hear representation from her and did not hear evidence from any other trans individuals or groups.'

The Amnesty representative was, I believe, non-binary?

Wow. On that scale, we got a 10.

Yes.
I was at work on the 16th and let out a very unprofessional squeal when I saw the result.

Does he even have standing to bring a case to the ECHR about a UK Supreme Court judgment, given that he is no longer UK resident?

Well no as far as i can ascertain, it would be like me complaining about some law or other in Spain.

He seems to be arguing that he was not allowed as an intervener in the SC hearing. Which is no argument at all, even if he was a resident in the UK.

Aside from the fact he is “out of time” on that issue.

“Rosa Parks’ choice of seat was political because of the colour of her skin,” [he] said, adding: “More prosaically, for me I am now political every time I choose where to pee.”

Christ. These disgusting males really co-opt EVERY single struggle and twist it to make them look a bigger victim than the original, don't they. As if I couldn't hate these men possibly any more. They really vile scum.

As I taught both my dc if you fly with the crows you'll be shot with them

That's a new one for me, I like it!

Crikey, former judge Mcloud is an extremely petulant man (using the EQ10 definition, ‘a biological male of any age’).

Fortunately, we are all well used to ignoring toddlers who demand cutted up pear.

Yes - the cutted up pear charm is both protection and reason. Once you have wrangled toddlers, you never forget.

The six-month delay for there even to be a decision about whether the court can accept the case (and the several year delay if they do accept it) is probably a central part of the purpose of making the application in the first place.

It gives the trans lobby months or years in which frame the issue as a human rights violation so severe that it has to be taken to the ECHR. It creates the illusion of a profound injustice. Many people won't look beyond that.

If the case is as hopeless as it appears to be, this must be obvious to McCloud, so his reasons must be political.

It will be a running sore until it is done.

Yes. First we had "Wait for the EHRC initial guidance"

Then "Wait for the EHCR amended guidance"

And now it will be "Wait for the ECHR to overturn it"

I was going to make a joke about keeping them busy, but ...

I actually do think it's shit that this man is bleeding people for a hopeless case, though. Much as I'm glad it's pointless, it's unfair to con people.

Same. He's a former judge, who's previously tried using judicial status to bolster his credibility and it's quite understandable that a less well informed observer might think he knows what he's talking about.

What will it be when they find out that the ECHR has no power to overturn it?

Well they've got 10 years to run with that one 😆

Although personally I think it will be six months, and then m'lud's hopeless case will be denied permission.

But then we'll have the "Wait for the Good Law Project appeal to the ECHR" 🙄

It's all spin and grift.

I understand what you are saying, but my acknowledgement of the existence of the Catholic Church does not imply a belief in transubstantiation.

ETA and neither does my use of the word transubstantiation!

Sorry, wrong analogy: Let us assume there is a Flat Earth Society, and a group who declare they are Martians, and maybe another group who believe the world is run by lizards. If they have websites, publications, meetings, then the fact the groups exist is not in doubt. Yet virtually nobody outside their membership lists would give equal credence to their ideas and, and to evidenced facts. The earth is not flat, and we do not use whatever language the Flat Earth Soc members would use to describe ourselves: Perhaps they call us 'Roundists' or 'Flat-Criticals'

We do not allow them to make us use their language. We are NOT Roundists. Nor are we, who do not belong in the Martian Society, prepared to call ourselves Mars-Critical.We certainly would not agree to obey anyone wearing green face paint and tin foil costume, and demanding we call him a Martian, and forcibly enter his absurd fantasy. If he is same-sex attracted, he can call himself a gay man and can legally marry a same-sex partner, so he need not pretend to be a woman. If he wants to pretend to be female, because he is an autogynephile fetishist, he is a danger to women and children, and must be legally obliged to keep his private fetish private, doing whatever he chooses alone or with consenting adults. Never in public.

Nobody Can Change Sex. Every Chromosome and cell and 'wiring' of a male body and brain stays male from the moment of conception. No 'transitioning' is possible. No amount of surgery turns a man into a chicken, or into a woman.

Hilarious! McCloud and team has more or less admitted the whole thing is an over the top scam with no hope of success in a revised version.

Less than 72 hours after launching their 'Strasbourg or Bust!' crowdfunder, Victoria McCloud, the Trans Legal Clinic & Oscar Davies gardencourtlaw
have heavily revised the text, deleting most of the third paragraph and adding a final sentence about 'excess funds'.

Will all the media who fell for this nonsense write articles about that?

I did wonder if his confession that this could take a decade was in order to prime people that it's in their best interest to keep up the donations.

I'm no lawyer, but is it legit to change the terms of a contract after people have handed over money?

In the event that excess funds are raised, this will be directly invested into our broader scheme of Strategic Litigation and trans rights work.

Because that doesn't sound vague at all!

i'm doing trans rights work, me 😄

They were very serious allegations for a judge & barrister from Garden Court Chambers to make against the Supreme Court. That the "trailblazing" ex judge was denied a hearing "without reasons, without a hearing and without any opportunity to provide evidence even though multiple "gender critical" groups were permitted to participate and provide evidence. This meant the court only heard one side of the story"

These claims have been repeatedly debunked and the lawyers nationally & on here have clarified the conditions for who and how the SC hears evidence from - all showing why this judge didn't meet any of the criteria.

Although it's good that these allegations have been removed from the crowdfunder, why on earth did were they made in the first place? Showing an ignorance of the law's not good if you're asking for money from the public to mount a legal case.

Chersfrozenface · 21/08/2025 07:25

Especially if you trained as a lawyer.

"Would you buy a second hand car from this man?" springs to mind.

All of the TRAs forget that ScotGov and Amnesty were given all the time they needed to argue their position
but
once the flow chart explanation had to break for lunch
their case was pretty doomed.

The utter arrogance of TRA groups like GLP and Stonewall pretending they would have done better
while refusing to explain which arguments they would have made
needs to be called out

Charabanc · 21/08/2025 08:17

I actually feel a very tiny bit sorry for the transes who have been given hope by these legal grifters. They seem to somehow think that the whole SC ruling will be overturned. They got all excited when the Good Law Project announced that they had WON!! against the EHRC. When it was only over a small bit of wording. Lots of them were upset about that, having thought that the whole thing was overturned.

So this trans ex-judge is going to lose - probably won't even be given permission to pursue the case by the ECHR. And even the GLP (who lots of transes think are brilliant 🙄) admits their case is only this:

We’ll be arguing in November that the EHRC was wrong to say employers can only provide gendered toilets based on “biological sex”, and wrong to ignore ways that companies and the public sector can provide trans inclusive men’s and women’s facilities.

And they won't even admit that the court will only be considering their case in November, and deciding whether or not to give it permission. The GLP says this on BlueSky, where they are grifting for money:

We are pleased to say that our case against the EHRC’s transphobic guidance will be heard in full in November. (My underlining)

But they say this on their actual website:

The High Court has set a date in November to consider Good Law Project’s challenge to the Equality and Human Rights Commission’s guidance

And the poor transes fall for the grift every time.

💥The fight goes on 💥 We are pleased to say that our case against the EHRC’s transphobic guidance will be heard in full in November. This is just the beginning, and we’re ready to fight it, together.

Given that most trans women have not had 'bottom surgery', it's not really clear where he is going with this argument.

So he admits that males in female spaces are dangerous, as a concept? Good, that's progress...

Charabanc · 21/08/2025 08:30

And now I'm even more confused about what the GLP is actually planning to do. They say this on their grifting crowdfunder page:

We believe the UK is now in breach of its obligations under the Human Rights Act and the European Convention of Human Rights and we plan to ask the High Court for a declaration of incompatibility.

Eh? This makes it seem like they're going to the ECHR. But they aren't, as far as I can tell? ETA: Or rather, it seems different from just challenging some bits about toilets in the EHRC guidance?

Who can tell with these grifters. They've raised nearly half a million pounds for this nonsense.

BendoftheBeginning · 21/08/2025 08:47

It makes for an interesting parallel, doesn’t it? The anti-woman application of trans rights was rolled out in stealth without anyone talking about it in public, so it just appeared in hospitals, policing, communications plans, social media moderation, and so on. Women were expected to put up and shut up with trans demands, “no debate.”

Now that there is an actual public debate and legal decisions, the trans side is retreating to just loudly agreeing among themselves that society HAS to implement whatever they’ve decided. Actually engaging with anyone else and looking for solutions that might work for everyone seems to be beyond them.
