The clerk came on and told us all

fanOfBen · 04/04/2025 12:21

The clerk (I assume) popped up some time after 11 while many of us were waiting, just to tell us that.

I wonder whether something happened to cause a delay, or they just decided that staying up all night to write their submissions hadn't worked well enough? I'd love to hear more about how this works. I mean, I assume that at least some of it gets written in advance, i.e. they each have a story they hope to be able to tell if the witnesses say what they hope they'll say, but presumably they don't always, and there's also a game of guessing what your opponent is going to argue based on what you saw of it and counteracting it... It would be interesting to hear about how the process of constructing the final document really does work.

AsWithGlad · 04/04/2025 12:28

Thank you both for letting me know. It was good of the clerk to do that.

AsWithGlad · 04/04/2025 12:32

I have heard that barristers do end up working overnight, perhaps getting a brief at 5pm and needing to appear at 10am the next day in a court that’s not particularly local to them.

You’d hope they wouldn’t have to do that very often, but so much can rest in what they do, especially in a trial/tribunal that’s only a week long.

I wonder how long this final afternoon will go on.

GCAcademic · 04/04/2025 12:39

Do we know if there's likely to be a decision (outcome) today, or whether it will be delivered later?

The main theme is anxiety that institutions cannot be sure if they are compliant or not,” says Smita Jamdar, partner and head of education

Now where can they go to get the right advice...? Definitely not Stonewall! Anyhow, that is EXCELLENT news. Funny how the threat of huge fines focuses the mind!😂

That is extremely hopeful!

At the very least while the government play the 'after you George after you Cecil' game with the EHRC, the whole damned issue can be regarded as too hot to handle.

When these places are afraid to take a side and harass/exclude women that's great, great news. Now let's have answers and provisions that work for all, including women wanting single sex provision, and robust responses to men whining that unless women are suffering they can't feel 'safe'.

I know we try to avoid making these threads personal, but it’s important to recognise when objectivity is overtaken by personal connections. It’s not the first time.

I've been lurking and reading this tribunal thread, thanks to all for the updates.

I'm actually still reeling from the connection here; that Dr Upton's dad is this witness bloke's boss. Hardly means he will ever be objective is it? They really are in their own little bubble aren't they? Madness...

TheOtherRaven · 04/04/2025 13:11

When you work in fields like say, coming into contact with the head offices of big charities, it begins to strike you how rather incestuous the system is. In essence it can appear that there's a relatively small group of people who all periodically swap roles and many move around within that same small circle. Friends. Relatives. Colleagues. And there's a noticable lack of diversity in terms of there being a group who all think alike and all agree with each other.

You might of course theorise on what happened to those with more diverse views voices and experiences.

Or on the idea so frequently mentioned of 'six people and their socks'.

Tis interesting stuff.

lnks · 04/04/2025 13:13

Will it likely be NC that gives her oral submission first? I have to go out at 4 so I’m really hoping to see her.

Times Higher Education have an interesting article today:Trans policies vanish from university websites after Sussex fine

Last week, the University of Sussex was fined a record £585,000 by the Office for Students, with the regulator accusing the institution of “failing to uphold freedom of speech and academic freedom” while handling the resignation of gender-critical professor Kathleen Stock. The case has prompted “anxiety” among English universities, legal experts tell Times Higher Education, with several institutions now appearing to feel the need to review their own trans equality policies for fear of similar rulings. Leeds, Exeter and Essex are among the universities to have updated their websites recently, removing documents or adding notices that trans inclusion policies are “under review”. “We’ve certainly had a number of conversations with institutions off the back of the decision. The main theme is anxiety that institutions cannot be sure if they are compliant or not,” says Smita Jamdar, partner and head of education at Shakespeare Martineau. “Complaints involving harassment, protected beliefs and freedom of expression were already complicated to handle even before the OfS decision and institutions may feel even less confident navigating the issues now.”

This is wonderful news!

Maybe Dr U's da and Mr GB don't really know each other very well, they just work in the same place, and it's just that There's a Lot of It About.
Especially in universities🙄
Please note, librarians, I did NOT say 'especially amongst librarians' - nobody wants to provoke the wrath of a librarian - remember Conan the Librarian?Grin

Peregrina · 04/04/2025 13:21

I note that of the three comments posted to the Time Higher Ed article the first is the usual trans whine. What exactly is a transwoman being excluded from? Male sport - no. Male changing rooms - no.

The second two comments are more thoughtful and reasonable.

Maya’s thread on the role of AdvanceHE is interesting too:

Ok, here we go

OhBuggerandArse · 04/04/2025 13:38

Two tweets submitted (tweeted yesterday) - can those of you with access to the hearing see them?

nauticant · 04/04/2025 13:38

Counsel for UCU gets permission for very last minute submission of new evidence. In this case tweets from KJK.

AsWithGlad · 04/04/2025 13:38

No. Nor KJK ‘s more recent tweets.

Edit: that was in reply to @OhBuggerandArse

nauticant · 04/04/2025 13:40

These tweets are thin stuff to discredit the idea that anyone except a fascist might use the term "adult human female".

lnks · 04/04/2025 13:40

Is he trying to link the documentary title to KJK?

nauticant · 04/04/2025 13:41

The most "important" of the "relevant" tweets:

Yes, he is.

Ereshkigalangcleg · 04/04/2025 13:42

I don’t understand how this interterf dispute is relevant. They’ve already said they don’t agree that KJK owned the phrase and their film did not feature her in any way. Many of the featured people publicly disagree with her.

LittleBigHead · 04/04/2025 13:42

Ha ha ha ha @ThatPithySheep that is a good spot! I've just looked at my university's guidance: cue hasty withdrawal at top speed by our captured HR department (various colleagues, including me, have the scars to demonstrate the idiocy of our HR people on this matter) :

This guidance document [...] is currently being reviewed and updated.

They give an email address for any questions about "transinclusion"

Thank you, thank you, thank you OfS and Professor Stock!

OhBuggerandArse · 04/04/2025 13:38

It's two tweets by KJK from yesterday, saying dictionary def is adult female human, and adult human female is her take on it. Barrister for UCU talking about IP.

Ereshkigalangcleg · 04/04/2025 13:55
