I do like where my weird brain went with this: picturing members of the EHRC pursuing NHS staff down the road, shaking SC judgements at them!

Peregrina · 18/04/2025 09:50

It will be even better when you publish the results if you can show what each Trust's policies were before 16th April and then see what they have said about the Supreme Court ruling. See if they are all still singing from the same hymn sheet.

So we still have a lot of work to do!

KnottyAuty · 18/04/2025 10:20

I’m trying to adjust the Jotform. I had to do loads of fiddling and checking on the London data. So updating the form should help make it all a lot easier 🤞🏻🤞🏻 Hoping to post it later today

Sorry I can't remember who did Croydon - @oviraptor21 ?
Any luck getting the missing FOI policies?
Ta

Apologies @KnottyAuty . I was on holiday and missed this.
I think I did Croydon and did look for FOIs. If you need me to look again I can do that - just let me know.

MadameBethune · 18/04/2025 11:35

Just a thought, but perhaps it would be preferable to capitalise on current press interest by trying to get the story out now based on the London results, rather than waiting until every Trust nationwide can be researched?

Also that may put additional pressure on the NHS generally to work cooperatively with the EHRC?

As the other Trusts are investigated, local press may pick it up again.

BettyFilous · 18/04/2025 12:38

I was thinking about this thread this morning. It is a good collective approach to capturing and understanding how many organisations are operating outside of the law. It could be a workable model for many sectors. It is also a solid archiving exercise so when people say “it wasn’t that bad, you’re misremembering” in a few years’ time the receipts are there. It was a great idea to make a start on this @KnottyAuty 👏

I've got a long weekend - I'm happy to put some time in to at least gathering the data for a region or something. It could be analysed at leisure, but if actually having it banked would be useful I'm in.

I think the plan was to attack the Midlands next, so as long as you announce on here which trust(s) you are looking at, I’d say go for it! There are specific things that we are looking for, but as a first pass try to find anything to do with single sex spaces and anything to do with transgender policies.

I am refreshing the Telegraph website every hour waiting for the London audit results to appear.... was told "this weekend" which hikes the anticipation when that means the 4 day bank holiday version!

@KnottyAuty has asked me to put up a list of the Midlands trusts (coming right up). She’ll be back in a bit to DM individual auditors links to the forms to fill out. NOTE: if you did the Scottish or London trusts, the forms have been updated for the Midlands, so please don’t use the old forms.

Ideally, can you pick one trust to start with, and then come back to pick more once that one is done - it just makes it easier to keep track of what is claimed and what is waiting to be claimed.

To claim a trust, just post on here which one you are claiming.

Think that’s it - shout if any questions!

I’ll double check later when I’m on my laptop but @umbel may have already covered some of these. I’ll double check and score off the list.

And to help galvanise our enthusiasm for the task - here’s a link to a union rep in The Midlands expressing concern about problematic GC views:

@TwoLoonsAndASprout I have done some of these previously, though annoyingly I didn't keep a list. @KnottyAuty will know which. Off the top of my head, these ones are already covered:

Birmingham and Solihull MHFT
Leicestershire Partnership
University Hospitals Leicester
North Staffordshire Combined
Sherwood Forest Hospitals
Shrewsbury and Telford
Royal Wolverhampton
University Hospitals North Midlands

Put me down for Nottingham Hospitals University NHS Trust and Nottinghamshire Healthcare NHS Foundation Trust.

Look at this EqIA which is about transitioning at work and time off being permitted from work from 2019. This is the first full and thorough EqIA that I have seen and it's not been prepared by the NHS.

See the very bottom of page 4:
We amended an early draft which had suggested that managers may consider objections to transgender individuals using what other employees perceive not to be the correct facilities as a disciplinary matter. We ultimately considered encouraging the use of disciplinary policies to deal with sincerely-held objections to be disproportionate and unlikely to foster good relations. However, we would expect objections to be raised using the correct channels. We would expect managers to deal with objections raised in an inappropriate manner or using inappropriate language to be handled as they would in any other context, i.e., potentially under the disciplinary process.

But also interesting/useful quotes all the way through.

I don’t know why a separate policy is required for this. There are many medical conditions which require significant time off for appointments, for example cancer or chronic autoimmune conditions. If I was an employee with a long-term condition and less favourable employer policies covering my medical condition I would sue for disability discrimination. Employers have beclowned themselves on multiple fronts by dancing to Stonewall’s tune, as well as increasing their liabilities.

Cantunseeit · 19/04/2025 14:44

Put me down for Northamptonshire Healthcare NHS Foundation Trusts please

Faffertea · 19/04/2025 17:30

@KnottyAuty I have sent you a PM on this topic.

teawamutu · 19/04/2025 18:47

I'll take:

Midlands Partnership NHS Foundation Trust
Shropshire Community Health NHS Trust
The Robert Jones and Agnes Hunt Orthopaedic Hospital NHS Foundation Trust

Once I've done those 3 I'll happily pick up others.
