NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #18

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to continue for 2 weeks. However, it is going to overrun and there will be an adjournment with the hearing resuming in July (current best estimate). The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

Access to view the hearing remotely was obtainable by sending an email request to [email protected] headed Public Access Request (Peggie v Fife Health Board) 4104864/2024 and requesting access.

However, as a result of problems with the livestreaming, apparently caused by a very large number of observers, remote public access to the hearing was suspended on Tuesday 11 February. It was suggested that it might be reinstated at some point but don't count on it.

SP did remove herself from the CR but her method was not good enough for DU as it was conspicuous and drew attention both to DU's presence in CR and to SP's discomfort with DU's presence there.

Exactly. I was able to observe earlier on in the week, and her face does not show much emotion at all. At one point I thought she looked rather flushed when questioning DU, but others said it was possible the heating was causing it. She is one cool cucumber.

Faye Russell-Caldicott is a pseudonym which I've mentioned in my updates (although that msg is probably buried under subsequent updates now).

There are different levels of anonymity, I'm more interested in keeping my real name out of the public domain because of past trauma, which is granted quite often, I think. If it goes my way, then no one would be allowed to publish my name, picture or other identifiers. I have not sought any other form of anonymity or 'hiding' details.

A little over 1k to go on the crowdfunder. This is just to pay for my legal representation in the 2nd prel hearing and other legal costs up to this point. I'm not expecting much to be left over, as I only campaign one step at a time. If anything's left over after paying fees, and I won't get anonymity, then I will direct the remaining small amount to another similar case.

Which is exactly what SP did but that was classed as wrong by Upton and brought up in his claim against her as bullying and harassment.

NHS Fife seem to be entirely unaware (or ignoring) the fact that sex realist beliefs are protected as much or more than (WORIADS) as the batshit idea you can change sex (which Stonewall claims = pc of gender reassignment but unsure if this has ever been tested in law).

Or, most importantly, what has happened to the Sad Chairs behind the witness box? Have they detransitioned back to the clerks' office where several people have been forced to hotdesk for a week during DUs evidence? Or maybe that should be hotchair.

Possibly not inaptly that made me think of JKR Dame Katy Denise and chair poverty 🤣
