NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #16

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to continue for 2 weeks. However, it is going to overrun and there will be an adjournment with the hearing resuming, possibly, in July. The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

Access to view the hearing remotely was obtainable by sending an email request to [email protected] headed Public Access Request (Peggie v Fife Health Board) 4104864/2024 and requesting access.

However, as a result of problems with the livestreaming, apparently as a result of a very large number of observers, remote public access to the hearing was suspended on Tuesday 11 February. It was suggested that it might be reinstated at some point but don't count on it.

It does look like ED has done what normal people do, and has obeyed the instructions not to look at prior witness testimony. She's being taken very thoroughly and gently through this by JR. I wonder if she's been told what to expect when NC gets going?

PP upthread has said didn't JR lie in court because she said the first investigation by ED wasn't an investigation.

She was not necessarily lying, she could have been misled by her clients. If they didn't disclose info to her and lied to her about ED's investigation being an investigation ( conveniently identifying as not one as soon as legal proceedings started) then all she could go on was what they said / their lies.

It seems JR may have been thrown under the bus. they're so arrogant in their totalitarian approach they really thought they could do this to a KC. However much of a TWAW believer JR is surely at some point she needs to protect her professional reputation here?

SP, they hadn't been in touch, I told them where we were in process, they said had a backlog, but gave her an appointment, the letter was informing AS that we needed to continue the suspension because we had not found a solution, and we needed to get occ health moving.
