By pointing them to the father / mother provisions is she not demonstrating that the GRA is not for "all purposes"?

Yes, this is about 9.3, working out when the Act does not apply. As with Haldane, it 'applies for all purposes except when it doesn't apply'.

These provisions are contained within the GRA itself.

So, in law, mother and father are biological sex terms.

Thanks for the new thread @ArabellaScott ✨️

On the 'after lunch point', when a judge asks you a question (I'm a barrister) it's good practice to answer it immediately otherwise the judge gets annoyed/frustrated. If you say 'I'll answer after lunch' it means you don't have a clue and will have a very frantic lunch break trying to come up with an answer!

Boiledbeetle · 27/11/2024 12:27

Sporting example now I think

porridgecake · 27/11/2024 12:27

I have to go out after lunch. And I will be sitting in a lecture. So I won't know how to live as a woman until much later. (I have short hair, don't wear make up and always wear trousers, jumpers and boots. So I was hoping to find out how to improve. I did give birth 3 times though. So there is that).

SallyForf · 27/11/2024 12:29

Becoming the sex of their acquired gender again.

Isn't it the kind of thing you say to a child in the hopes that by the time lunchtime is over, they'll have forgotten all about whatever followed 'Muuuuuuum. can we....'Smile

What’s your take on the two sides’ cases so far @WeeBisom ? It’s difficult for us non-lawyers to parse the merit and elegance of their arguments. To an untrained ear, yesterday’s submissions seemed more substantial and compelling. I don’t know if the legal precedents they drew on were appropriate and compelling ones, for example.

Thank you for new thread

Haha, yes exactly, you desperately hope they will have forgotten and won't raise it again. But it's the Supreme Court, I bet when the barrister comes back they will immediately say ' so , you said you would answer this after lunch..."

Pretty sure giving birth is a biological determinant, so doesn't count according to today's arguments.

I'd put some lipstick on before leaving to cover yourself, or you might be inadvertently living as a man.

ObstinateHeadstrongCrone · 27/11/2024 12:31

Thank you for the new thread and to the invaluable posters. I’m listening at work and also checking in here. The 2 barristers this morning have not looked comfortable at all. Ben C and AON seemed more comfortable and on top of things. I suspect some cognitive dissonance from the SG barristers

HarpQuartet · 27/11/2024 12:32

That sporting point didn't go where I thought it was going - I thought it was going to end up saying that the person with the GRC could be excluded because it was unfair on everyone else...

Great. I’m sure surrogacy agencies will welcome any transwomen who want to support couples in achieving their dream of family life. Right?

legalalien · 27/11/2024 12:33

So glad I found this thread. Missed yesterday’s session but have been watching today and am losing the will to live.

highame · 27/11/2024 12:33

😂

ickky · 27/11/2024 12:34

😂😂😂

Ereshkigalangcleg · 27/11/2024 12:34

The judges are really confused what she means!

ILikeDungs · 27/11/2024 12:34

"I will move on..."

HarpQuartet · 27/11/2024 12:34

And now three judges or maybe four all questioning something

SallyForf · 27/11/2024 12:34

Getting tetchy with the judges.

chilling19 · 27/11/2024 12:34

Ooh, snippy again

ItsAllGoingToBeFine · 27/11/2024 12:34
