NHS Fife tries to silence nurse

Hoardasurass · 13/10/2024 09:36

So as has been mentioned on threads about the Darlington nurses a nurse is sueing NHS Fife over its trans staff policy.
The poor nurse was forced to get changed infront of a man in the female changing facilities, when she complained about it she was 1st told to change in a cupboard if she didn't like it, then they tried to bully her into swapping shifts so she didn't work with the man in question (she wouldn't), then they wanted her to move hospital (again she refused) so then they suspended her without pay for months until her solicitor got involved and now they are trying to gag her by insisting that the court case (starts in February) must be held in secret (I wonder why) and will be in crt next month asking to restrict reporting on the case.

This case is really important in Scotland because the trans staff policy that's going on trial in this case is the Scottish government's own policy used in all public sector organisations in Scotland and works on self id. So when this case is won it will finally kill the Scottish government's self id policy in all public bodies

Oh no. Looks like she might end up having to appeal if the Judge’s previous form is to be considered:

Yet again, misogyny, from the looks of it. Why on earth would he not believe that? I'd think anyone who'd been bereaved and lost their job would likely be telling the truth about an emotional breakdown and especially if backed up by a psychiatrist.

She didn’t look emotional and fragile enough on the stand. Though of course if she did then her testimony would have been dismissed as being emotional (hysterical).

Hmm the judge didn't believe or pay any heed to dr Uptons psychiatrist either. I wonder if he just has a problem with therapist 🤷‍♀️

It was Dr Upton’s therapist not a psychiatrist - there is about twelves years difference in the amount of training between the two. Dr Upton’s therapist was dismissed as she simply advocated for Dr Upton and did not use any of her several weeks of training to provide an assessment from a professional perspective.

Is that the certification from Pink Therapy?

From what I can see there have been 2 different judges involved. Tinnion earlier on (I think he spoke about the therapist - could be wrong) and more recently Kemp. No idea how the ET system works.

By the way, I went looking for information about what judge will be hearing the case. I didn't find it, but after registering(!) at www.courtserve.net I was able to download a .rtf file (!!) which listed the case, and it says at the top:

"Requests from the media and members of the public to observe a hearing remotely should be made in advance to [email protected] to allow for inclusion during the hearing set-up. The naming convention in the subject heading of the email request should read "MEDIA OR PUBLIC ACCESS REQUEST - AN Other v AN Other - Hearing Date." "

So for people wanting access, that's more precise info about exactly how to request it, if one wants to be precisely correct.

Someone on X has published a photograph they are claiming is Dr Upton. I don't know if it is or not.

Well, @RoyalCorgi, he does look very similar to the chap in the graduation video. Odds on it's a match.

Rightsraptor · 25/01/2025 14:27

I asked for a log-in link to the tribunal and got an immediate answer saying to apply on 31st January and not before.

Yes, that is the one from his graduation ceremony.

Harassedevictee · 31/01/2025 09:50

I have just been emailed my link for Monday.

HarpQuartet · 31/01/2025 11:24

Me too, and it's really tickled me that their email to me starts "Dear Madam".

Harassedevictee · 31/01/2025 11:33

@HarpQuartet I got Dear Sir/Madam, hedging their bets with my clearly female name. 😂

donationsMakeMeFeelBetter · 31/01/2025 12:21

I got Dear Sir/Madam, also with a clearly female name. My guess is that this just means the person answering the emails has realised there are going to be enough of these that it's worth saving the body of the email just once and then being able to copy and paste the whole thing :-)

Signalbox · 31/01/2025 12:38

who do we email to get access? I can’t find the info.

I emailed [email protected] and referred to Peggie vs Fife Health Board and Dr. B Upton starting on Monday 3 January 2025 and asked to be granted access for online viewing.

The access credentials arrived in about half an hour.

nauticant · 31/01/2025 13:24

I meant February, not January. At least I got it right in my email.

wantmorenow · 31/01/2025 15:04

Hi can someone tell me what to write in heading of email to request remote access please? Many thanks

OOps got it now - Thanks

BernardBlacksMolluscs · 31/01/2025 16:05

I’m so busy at work that I really can’t tune into this. I have high hopes for entertainingly bonkers levels of cognitive dissonance on the part of NHS Fife so I’m sad to miss it. I’ll be avidly catching up here ( much to the discomfort of the NHS Fife brief by the sounds of things)

Mmmnotsure · 31/01/2025 17:51

The hearing has now been moved to Dundee, but applying to the Edinburgh ET address still works:

Will the remote access link still work?
