For Women Scotland heading for Supreme Court

You can read the reasons etc in For Women Scotlands crowdfunder. They are launching this review
UK Supreme Court: The Definition of Sex in the Equality Act

The Inner House of the Court of Session Judgment

We believe the Equality Act was drafted on the basis of the ordinary, common law understanding of the biological differences between the two sexes. The protected characteristic of “sex” in the Equality Act is defined as a reference to a man or a woman, where man means “a male of any age” and woman means “a female of any age”. We think it is quite clear that these are distinct and separate groups and that “woman” is not a mixed-sex category.

However, in our recent judicial review, For Women Scotland v The Scottish Ministers [2023] CSIH 37, the Inner House took the opposite view and decided there is a relationship between the Gender Recognition Act 2004 (GRA) and Equality Act 2010 and held that the meaning of sex in the Equality Act incorporated the GRA framework.

The court decision stated that a person with a Gender Recognition Certificate (GRC) in their acquired gender has the protected characteristic of gender reassignment. Separately, they also possess the protected characteristic of sex according to the terms of their GRC and have a presumptive right to access the single-sex services of their acquired gender.

The Supreme Court will consider a request brought by For Women Scotland (FWS) who argue there are “strong grounds” for its challenge, which will almost certainly overturn contentious Scottish government legislation if successful.Campaigners for women’s “sex-based” rights reacted with delight to the news, including Magi Gibson, the poet, who posted on X/Twitter, that it was “game on” on in the “fight for the protection of women’s rights within the UK legal system”.Dennis Noel Kavanagh, a lawyer and the director of Gay Men’s Network, said: “Getting permission to go to the Supreme Court is really hard and very rare but FWS have it. The question ‘what is a woman’ in law will now be heard by our highest court. Massive news.”

"After lunch"

Again!

She's going to be busy at lunchtime with all the 'reflecting' she's going to have to do!

Saying. "Presumption qualified or unqualified" shows you have a law degree....but that you'll "explain further after lunch"

I wonder what wonderfood she's going to have for lunch - 'I'll have what she's having'😂

Maybe some salmon???
[in-joke for Irish people and anybody familiar with An Bradán Feasa]

Snowypeaks · 27/11/2024 11:54

I see I am way behind, so probably cross posting.
Apologies, all.

Maybe clownfish are on the menu? 🤔

Pepe good point

highame · 27/11/2024 11:56

lot of presumptions in 9.1

Just caught up, might be out of sink

CriticalCondition · 27/11/2024 11:57

I think this is why these two counsel are tag- teaming. So one can scrabble for answers while the other is on her feet.

TWETMIRF · 27/11/2024 11:58

I think that living as a woman means telling women to suck on your girl cock

Boiledbeetle · 27/11/2024 11:59

I'm so looking forward to "after lunch". We will finally have our question answered.

So excited

She has no examples. Will add it to the list of things to come back to the court on.

Hey it's a bit early for talk like that, TWETMIRF!
Save it till after the watershed. Or after lunch😁

Shortshriftandlethal · 27/11/2024 12:00

Woman in back row finding the growing 'after lunch' list quite amusing.....

CriticalCondition · 27/11/2024 12:00

Lunch!

GCITC · 27/11/2024 12:00

Has anyone today been able to immediately answer the judges question?

larklane17 · 27/11/2024 12:00

The all day Big Breafast cafe is going to be busy during lunch wot with these lawyers needing all this brain food.

musicalfrog · 27/11/2024 12:00

I hope they've got plenty of researchers beavering away behind the scenes!

SallyForf · 27/11/2024 12:00

She is getting right on my pip.

ILikeDungs · 27/11/2024 12:00

'add it to our list of matters to come back to the court on' as an alternative to saying 'after lunch'

ItsAllGoingToBeFine · 27/11/2024 12:00

I didn't watch yesterday- were there this many questions from the judges ?

ickky · 27/11/2024 12:00

Have you got any examples....

Have I fuck

All will be made clear after lunch.

Harassedevictee · 27/11/2024 12:01

They actually seem quite unprepared. I know yesterday there was a defined structure to cover the points as logically😂 as possible but not this we will find the answers later.

No.

It clearly means anything that someone with a GRC wants it to mean.

It's hard to prepare when you haven't got a leg to stand on.
