She has just tweeted that she is appealing the decision to dismiss her claim against Stonewall in her recent case.

No news on if a garden is needed to be seeded though!

It's typical to do so. It comes down to the merit of the case really (and the mood of the judge). Lawyers are being lawyers in asking this. They naturally have a vested interest to not want to pay her costs.

I get that they don’t want to pay her costs, but to ask that she pays theirs - when they are guilty of discrimination against her - has blown my mind. I’ve probably missed something. Or is it just the lawyer equivalent of attack is the best form of defence?
Wishing her all the very best today.

Chrysanthemum5 · 29/06/2023 08:30

Who will be the judge? Do we know?

RedToothBrush · 29/06/2023 08:35

Think this largely covers it:

The general rule is that the loser pays the winner’s costs. In practice, the court has flexibility as to when one party may be responsible in whole or in part for the other party’s costs.There are also exceptions to the general rule. These include cases where a successful claimant recovers no more than nominal damages; or where the winner acted improperly or unreasonably during proceedings. In exercising its discretion on costs, the court is required to have regard to all the circumstances and particularly to the following matters:

The extent to which the parties followed the applicable pre-action protocol;

The extent to which it was reasonable for the parties to raise, pursue or contest each of the allegations or issues;

The manner in which the parties pursued or defended the action or particular allegations or issues;

Whether the successful party exaggerated the value of the claim;

Whether a party was only partly successful;

Any admissible offer to settle.

Hence why they would go after Allison...

Good luck to Allison today. I hope she stings them for every penny.

chilling19 · 29/06/2023 10:11

Am linked in - it is Judge Goodman

chilling19 · 29/06/2023 10:12

40 min break

Ameanstreakamilewide · 29/06/2023 10:12

It's lovely to see Judge Goodman again, i must say.

No Andrew Hochhauser today, though.

IcakethereforeIam · 29/06/2023 10:18

All the best Allison. I admit I thought it was for some sort of compensation. I'm aghast she could wind up paying all the costs. That wouldn't seem like justice.

Ameanstreakamilewide · 29/06/2023 10:43

The panel need a little more reading time, so they'll be back at 10:55.

DifficultBloodyWoman · 29/06/2023 10:46

Will a decision be made today or is it just a hearing of the claims?

Chrysanthemum5 · 29/06/2023 10:47

Ah I missed judge good man good to have her back

Ameanstreakamilewide · 29/06/2023 10:52

Martin Reuby is still in attendance, too. He's excellent.

I hope it all goes in Allison's favour today and the fact that GCC were acting on SW advice echoes loud and clear.
